<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DO~IN PROCEEDINGS PURSUANT TO CHAPTER
<br /> 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br /> THE CONSTRUCTION, EXPANSION AND IMPROVEMENT OF THE PINNERS POINT SEWAGE TREAT-
<br /> MENT PLANT.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinafte~
<br />specified in and to the hereinafter described parcel of land situated in the City of Ports-
<br />mouth, Virginia, for the purpose of constructing, improving and enlarging the Pinners Point
<br />Sewage Treatment Plant; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase the property described
<br />herein, necessary to the project because of a defect in the title to the property in that
<br />the present record owners cannot be located; and
<br />
<br /> WHEREAS, advancement of the work and use of said project will be delayed unreasonably
<br />if said property is not made available to the CitY.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Attorney is directed to institute Eminent Domain Proceedings against the following
<br />property situated in the City of Portsmouth, Virginia, for the purpose of acquiring fee simple
<br />title therein, together with any and all easements of access, light or air incident to the
<br />lands of the landowner abutting upon said property, in accordance with and pursuant to Section
<br />2.06, 2.0? and 2.08 of the Charter of the City °f Portsmouth (Chapter 471 of the Acts of Assem
<br />1970, as ameffded), and to deposit to the credit of the Clerk of the Circuit Court of the
<br />City of Portsmouth, Virginia, as provided by law, the sum hereinafter specified to compensate
<br />the owners of the parcel of land described as follows:
<br />
<br /> All that certain lot, piece or parcel of land, with the improvements thereon
<br />and the appurtenances thereto, belonging, situate, lying and being in the City
<br />of Portsmouth, Virginia, known and designated as Lot 187 on the Plat of
<br />Portsmouth Waterfront Land Company, recorded in the Clerk's Office of the Circuit
<br />Court of the City of Chesapeake, Virginia, in Map Book 3, page 91.

<br /> The names of the property owners are PortsmoUth Waterfront Land Company, Cherokee D.eveiopr
<br />ment Corporation, C. D. Lipford and F. A. Lipford'
<br />
<br /> The amount to be paid is $1,250,OO."
<br />
<br /> Ayes: Early, Elliott, HolleY, Oast, Wentz, Davis
<br /> Nays: None
<br />
<br /> 76-353 - "Consideration of a resolution to the Commonwealth of Virginia, Department of
<br />Highways and Transportation setting forth the City's two highest priority projects for Sta~e/
<br />City participation and committing the City's 15% share for these two projects.
<br />
<br /> This resolution authorizes the Highway Department to proceed with design on the next two
<br />State/City funded highway projects as funds become available. The City of Portsmouth has
<br />established, after completion of the Western Freeway, the extension of the Western Freeway
<br />from thenne~ Western Freeway Bridge to the Mid-town Tunnel and the extension of Victory Boule-
<br />vard to Portsmouth Boulevard as the two highest priority projects within the City of Ports-
<br />mouth~ The City Manager recommends adoption."

<br /> On motion of Mr. Wentz, and secondedbby Mr. Elliott, the following resolution was adopted
<br />and by the following vote:
<br />
<br />"A RESOLUTION SETTING FORTH THE CITY OF PORTSMOUTH'S HIGHEST HIGHWAY PRIORITY
<br />PROJECTS FOR STATE-CITY PARTICIPATION AND COMMITTING THE CITY TO PAY ITS IS%
<br />SHARE OF THE COSTS OF SUCH PROJECT.
<br />
<br /> ~ WHEREAS, the State has requested the City to designate the next two highest highway
<br />priority projects to be designed and constructed when funds become available; and
<br />
<br /> WHEREAS, the Victory Boulevard to Portsmouth Boulevard extension was dropped from the
<br />City's priority list due to the excelleration in cost of the Western Freeway; and
<br />
<br /> WHEREAS, the Western Freeway Bridge and Western Freeway's two (2) lanes West to the
<br />City of Suffolk are under design and construction; and
<br />
<br />WHEREAS, the two (2) highest priorities of the City of Portsmouth are:
<br />
<br />(1) Extension of Victory Boulevard to Portsmouth Boulevard; and
<br />
<br />(2) Extension of Western Freeway from the new bridge approach eastward to the
<br /> midtown tunnel.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the two (2) highest highway priority projects for StateCity participation are:
<br />
<br />(1) Extension of Victory Boulevard to Portsmouth Boulevard; and
<br />
<br />(2) Extension of the Western Freeway from the new bridge approach eastward to
<br /> the midtown tunnel.
<br />
<br />BE IT FURTHER RESOLVED that the City commits its 15% share to cost of such priorities."
