3O <br /> <br />August 24, 1976 <br /> <br /> Bids have been received by the developer's architect to convert a portion of the Middle <br />Street Mall and the Mervis Building into a Senior Citizens Center under Title XX funding. Bas <br />on the low bid, it appears that the cost per square foot under a 10 year lease will average <br />approximately $5.$0 per square foot. The property will be leased from the Portsmouth Local <br />Development Company, Inc., and the TruSt Department of Citizens Trust?Bank, who are trustees <br />of the Mervis property." <br /> <br /> Mayor Davis stated: I am a director of the Portsmouth Local Development Company, Inc., <br />and vacate the chair and ask the Vice Mayor to preside over the rest of these proceedings as <br />to this motion. <br /> <br /> Motion of Mr. Oast and seconded by Mr. £11iott, that authorization be granted to <br />execute a lease, was adepted by S-1 (Davis-abstaining) vote. <br /> <br /> 76-557 - The following report from the City Manager on the petition from Park Manor <br />residents on recreational facilities for that area was presented: <br /> <br />' "Below is a response to the petition of children <br />additional recreational facilities and programs. <br /> <br />in the Olive Branch section requesting <br /> <br /> First, we apologize for the two of four occasions which the Fun Wagon arrived late. <br />On July 1, the Wagon was five minutes late due to a sudden illness in the driver's family. <br />A backup driver had to be located. On July 29, the Wagon was fifteen minutes late due to <br />the time needed to dismantle the spray hydrant operation from the previous session. There <br />are two scheduled sessions for the Fun Wagon, 10:00( a.m. to 2:$0 p.m. and from 3:00 p.m. <br />to 7:00 p.m. The latter time does overlap the dinner hour whereas the earlier session over- <br />laps the noon hour. For next year's program we will consider a change in times, e.g., having <br />the Fun Wagon scheduled at Olive Branch from 10:00 a.m. to 2:50 p.m., or perhaps starting <br />the ~orning {and evening) session earlier. <br /> <br /> Additional recreational programs held this summer at the Olive Branch Elementary School <br />include mobile tennis (August 1620) and mobile art (July 29). The mobile recreational pro- <br />grams are used to supplement recreational facilities in various neighborhoods throughout <br />the City and have been well received. <br /> <br /> At the Olive Branch Elementary School there is a playground, little league ballfield <br />and four basketball goals. However, there is no play equipment such as swings. Nevertheless, <br />oUr preliminary draft of facilities and open space by neighborhood shows Park Manor ranking <br />above the average of neighborhoods in the City. Up until five years ago, there was an organiz. <br />ed summer praygr°und program at Olive Branch, which was discontinued because of low attendance. <br /> <br /> We request the opportunity, during the upcoming budget year, to evaluate recreational <br />needs throughout the City and to make recommendations for additional programs and facilities." <br /> <br /> Motion of Mr. Oast and seconded by Mr. Wentz, the repett to be received as information, <br />was adppted by unanimous vote. <br /> <br /> 76-350 - Consideration of an ordinance to amend the City Code of the City of Portsmouth, <br /> 1975, by amending Section 32-5 thereof pertaining to construction of streets and sidewalks. <br /> <br /> This amendment will authorize the City Manager or his designee to issue revocable permits <br />for encroachment on the City's right-of-way when existing buildings are improved and altered. <br />Such permit may be revoked by the City Manager or his designee. This ordinance will also re- <br />cognize encroachments constructed prior to the date of the passage of this ordinanee and place <br />them in the category of being constructed under a revocable permit. Such permits may be re- <br />voked by the City Council or the ~eneral Assembly. Any other encroachment constructed by an <br />owner will be unlawful and punishable under the law. The City Manager recommends adoption." <br />(76-330 referred £rom meeting of August 10, 1976) <br /> <br />Motion of Mr. Early and seconded by Mr. Elliott, to adopt on first and final reading. <br /> <br /> Substitute motion of Mr. Holley and seconded by Mr. Elliott, the ordinance to be amended <br />under Sec. 52~5 (c) to read "City Council or i~e~ri~es'ignee", and was adoPted by unanimous <br />vote. <br /> <br /> The following ordinance was adopted on first and final reading, <br />£o~ewing vote: .~ <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br />AMENDING SECTION 32-S THEREOF, PERTAINING TO OBSTRUCTION IN STREETS AND SIDEWALKS." <br /> <br />Ayes: Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> - NEW BUSINESS - <br /> <br /> 76-361 - The following letter from the School Board was presented: <br /> <br /> "At the regular meeting on August 12, 1976, the School Board of the City of Portsmouth <br />adopted the attached resolutions and ,~ected that they be forwarded to City Council for action, <br /> <br />,d <br /> <br /> <br />
