<br /> Consideration of a resolution authorizing the City Manager to do whatever is

<br />necessary to grant an easement and take whatever actions necessary to protect Portsmouth's
<br />water supply. ~ ~

<br /> This resolution authorizes the City Manager to grant an easement across Lake Meade and
<br />such easement to include whatever actions necessary to protect Portsmouth's water supply
<br />system. This resolution also requests that the granting of the easement be based on an inde-
<br />pendent appraisal and the City of Suffolk be required to pay the appraisal fee in exchange for
<br />granting of the easement. The easement involves 575 feet on land and 565 feet in the lake.
<br />The City Manager recommends adoption."

<br /> On meeion of Mr. Barnes and seconded by Mr. Early, the following resolution was adopted,

<br /> "A RESOLUTION AUTHORIZING THE CITY TO GP~NT AN EASEMENT ACROSS LAKE MEADE AND
<br /> ~. iOCHER ~RO:PERTY~'LOCATED IN THE CITY OF SUFFOLK UPON CERTAIN CONDITION; AUTHORIZING
<br /> THE CITY MANAGER TO HAVE AN INDEPENDENT APPRAISAL OF SUCH PROPERTY.

<br /> WHEREAS, the City of Suffolk has requested that it be granted an easement on property
<br />owned by the City of Portsmouth including Lake Meade for the purpose of laying a sixteen
<br />(16) inch water main.
<br />
<br /> NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />it authorizes the granting of an easement on property owned by the City of Portsmouth includir
<br />Lake Meade to the City of Suffolk upon condition that the City Manager place in such easement
<br />all necessary provisions to protect the City of Portsmouth's water supply facilities.

<br /> IT IS FURTHER RESOLVED that the City Manager is authorized to seek to have an independent
<br />appraisal of such property and to charge for the easement the fair market value and the cost
<br />to the City of Portsmouth for making of such appraisal." ~

<br />by the ~ity under eminent domain proceedings, said property being necessary for the construc-
<br />tion of the extension of the Seawall and the North Marina pursuant to the proposed Crawford
<br /> Harbor Development Project."

<br /> On motion of Mr. Wentz and seconded by Mr. Oast, the following resolution was adopted,

<br />"A RESOLUTION TO PROVIDE FOR TI~ ACQUISITION OF CERTAIN PROPERTY BY TNE CITY
<br />OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DO~IN PROCEEDINGS PURSUANT TO CHAPTER
<br />471 OF THE ACTS OF ASSEMBLY, AS ~MENDED, SAID PROPERTY BEING NECESSARY FOR
<br />THE CONSTRUCTION OF THE EXTENSION OF THE SEAWALL AND THE NORTH ~V[ARINA PURSUANT
<br />TO THE CRAWFORD HARBOR WATERFRONT DEVELOPMENT PROJECT.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest specified
<br />in the hereinafter described parcel of land, situate in the City of Portsmouth, Virginia,
<br />for the p~rpose of constructing the extension of the Seawall and the North Marina of the
<br />Crawford Harbor Waterfront Development Project.
<br />
<br /> WHERgAS, negotiations have taken place with the
<br />thereof; no final agreement has been reached and the
<br />seawall and North Marina is to begin immediately.

<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:

<br /> The City Attorney is directed to institute eminent domain proceedings if negotiations
<br /> fail against the following property situate in the City of Portsmouth, for the purpose of
<br /> acquiring fee simple title therein, in accordance and pursuant to Sections 2.06, 2.07 and
<br /> 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970,
<br /> as amended), and to deposit to the credit of the Clerk of the Circuit Court of the City of
<br /> Portsmouth as provided by law, the sum hereinafter specified to compensate the owners of
<br /> the parcel of land known, numbered and designated as Parcels Al, A2, and A5 as shown on that
<br />· :e-e~t:aih fla~:entit.l~d~ "Plat Showing Survey of Property for Crawford.Harbor Project, Portsmout
<br /> Virginia", dated April 9, 1976, made by Baldwin & Gregg, Ltd., reference to said plat being
<br /> made for a more particular description of the property. A copy of said plat is attached
<br /> hereto.

<br /> The names of the property owner are: Allen Fleder and Armond Caplan and
<br />to be paid is $76,113.OO."
