<br /> 76-379 - "Consideration of a resolution authorizing the City Manager to release and vacate
<br />a 15' drainage easement on Parcel 7 Northside Redevelopment Project, VA-R-69.

<br /> Minor subdivision~plats for reuse parcels 7 and 7A in the N6rthside Redevelopment Project
<br />shows dedicatedtto the City of Portsmouth a 1S' drainage easement, which runs from the west
<br />side of Elm Avenue to approximately the middle of the northern boundary of parcel 7. The City
<br />no longer requires this drainage easement since the removal of streets in this area has been
<br />accomplished. The City Manager recommends authorization to execute the necessary documents
<br />to release and vacate the drainage easement."

<br /> On motion of Mr. Wentz and seconded by Mr. east, the following resolution was adopted,

<br /> WHEREAS,Ia minor subdivision plat ~ntitled "Plat Showing Survey of Reuse Parcels 7
<br />and ?A, Portsmouth, V~rglnla, for Northside Redevelopment Project, VA~39", dated July 1,
<br />1976, revisediJuly 14, 1976, prepared by Baldwin & Gregg, Ltd., Engineers, Surveyors, and
<br />Planners, Portsmouth, Virginia, and duly recorded in the Clerk's Office of the Circuit Court
<br />of the City of Portsmouth, Virginia, in Map Book 9, page 93, dedicated to the City of Ports~,p
<br />mouth a certa~.n 15 foot drainage easement which runs through said Parcel ? from the West
<br />side of Elm A~'enue to approximately the middle of the northern boundary of said Parcel ?
<br />and is more f~tlly described on the plat attached hereto; and

<br /> WHEREAS, said 15 foot drainage easement is no longer required by the City of Portsmouth
<br /> for the colle~:tion of water from the City streets.

<br /> NOW, THEIEFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br /> that the CitylManager be, and he hereby is, authorized to eXe'cute such deed and documents
<br /> of release an4 vacation as may be necessary to release and vacate the interest of the City
<br /> in said 15 foot drainage easement on Parcel 7, Northside Redevelopment Project, VAR-S9,
<br /> Portsmouth, V~rginia."

<br /> 76-380 "Consideration of a resolution authorizing the constructionoof sidewalks in the
<br /> 700 Block of ~0uglas Avenue, where standard sidewalks do not exist.

<br /> The abutting land owners shall be assessed at the rate of $2 per front lineal foot; and
<br />~irec~ed th&t~an~ abstract of this resolution be filed showing the estimated amount that will
<br />'b~ assessed' a~ainst said land owners. Seventy-five percent of the abutting land owners liv-
<br />ing in the 70~ Bloclkof Douglas Avenue having petitioned the City for standard sidewalks which
<br />do not now ex%st. This resolution authorizes construction and places the assessment of ~2 pe~
<br />front lineal foot against said abutting land owners. The City Manager recommends.adopti6n."

<br /> "A RESOLMTION AUTHORIZING THE CONSTRUCTIO~ OF A SIDEWALK IN THE 700 BLOCK OF
<br /> DOUGLAS AVENUE BETWEEN 703 DOUGLAS AVENUE AND 727 DOUGLAS AVENUE, WHERE STANDARD
<br /> SIDEWALKS DO NOT NOW EXIST; THE ABUTTING LANDOWNERS SHALL BE ASSESSED AT THE
<br /> COST OF $2.00 PER FRONT LINEAL FOOT; AND DIRECTING THAT ABSTRACT OF THIS RESOLU-
<br /> TION BY gECORDED TOGETHER WITH A STATEMENT SHOWING THE ESTIMATED AMOUNT THAT
<br /> WILL BE ASSESSED AGAINST SUCH LANDO$YNERS.

<br /> wHEREAS,~by petition submitted in accordance with law, certain abutting lando%mers
<br /> have petitioned the City of Portsmouth to construct a sidewalk in the 700 block of Douglas
<br /> Avenue betwee~ 703 Douglas Avenue and 727 Douglas Avenue, where standard sidewalks do not
<br /> now exist; th9 abutting la'ndowners shall be assessed paying $2.00 per front lineal foot
<br /> of the cost o~ said sidewalk; and
<br /> WHEREAS, notice has been duly given to the abutting landowners, ~s provided by law,
<br /> that a hearing would be held before the Council of the City of Portsmouth on September 14,
<br /> 1976, at 7:301P.M., in the Council Chambers; and
<br />
<br /> WHEREAS,[said hearing has been duly held and in the judgment of the Council the said
<br />sidewalk should be constructed.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. That/the construction of a sidewalk in the 700 block of Douglas Avenue between
<br />703 Douglas A~enue and 727 Douglas Avenue, where standard sidewalks do not now exist, is
<br />hereby authorized.
<br />
<br /> 2. hat the abutting landowners shall be assessed at a rate of $2.00 per front lineal
<br />foot pursuantlto a petition signed by seventy-five (75%) percent of the property owners
<br />affected by t~e requested improvements.
