October 26, 1976 WHEREAS, the applicant and the Planning DireCtor have done all things required to be done in connection with said application and the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (a) That the Use for which the use permit hereinafter described is sought: (I) Will not adversely effect the health or safety of persons residing or working in the neighbor- hood of the proposed use; (2) Will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood; and, (3) Will be in accord with the purposes of the Zoning Chapter of the City Code. (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40- 78[b} of the City Code to operate a home for the aged on the property described as follows: Beginning at the northeast corner of Fifth Street and Portsmouth Boulevard; ~hence east along Portsmouth Boulevard approximately 150' to a side lot line; %h~Rce north approximately 125' to a point; thence west approximately 150' to the east right-of-way line of Fifth Street; thence south along said right-of-way ~proximately 125' to Portsmouth Boulevard, to the point of origin. (c) The granting of this use permit is subject to the following condition: Complying with all requirements and receiving all permits from the State and City." Ayes.' Barnes, Early, Elliott, Holley, Oast, Davis Nays: None 76-404 - On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution ~pproved on first reading at the Public Hearing meeting of October 11, 1976, was adopted, and by the following vote: (g) "A RESOLUTION GRANTING A USE PERMIT TO OPERATE A GASOLINE SERVICE STATION ON CERTAIN PROPERTY SITUATE NEAR THE INTERSECTION OF HODGES FERRY ROAD AND PORTSMOUTH BOULEVARD. WHEREAS, Southland Corporation has made an application pursuant to Section 40-70(b) of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said applicationn and the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (a) That the use for which the permit hereinafter described is sought: (1) Will not adversely effect the health or safety of persons residing or working in fhe neighbor- hood of the proposed use; (2) Will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood; and [3) Will be in accord with the purposes of the Zoning Chapter of the City Code. (b) The Cityof Portsmouth is hereby granting a use permit pursuant to Section 40- 70(b) of the City Code to operate a gasoline service station on the property described as follows: Beginning at the southeast corner of Hodges Ferry Road and Portsmouth Boulevard; thence southerly along the east side of Hodges Ferry Road approxi- mately 115' to a side property line; thence easterly along .said line approximately 184' to a point; thence northerly approximately 110' to the south right-of-way line of Portsmouth Boulevard; thence westerly along said right-of-way approximately 159' to Hodges Ferry Road, the point of origin. (c) The granting of this use permit is subject to the following condition: That petitioner shall construct all improvements per site plan prior to his petition for a use permit." Ayes: Barnes, Early, Elliott, Holley, Oast, Davis Nays: None 76-404 On motion of Mr. Early and seconded by Mr. Elliott, the following ordinance approved on first reading at the Public Hearing meeting of October 11, 1976, was adopted, and by the following vote: (i) "AN ORDINANCE TO ~END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING AND REORDAINING SECTION 40-71(b)OF SAID CODE PERTAINING TO THE USES WHICH ARE PERMITTED WITHIN THE COMMERCIAL C-2 DISTRICT UPON THE GRANTING OF A USE PERMIT." Ayes: Barnes, Early, Elliott, Holley, Oast, Davis Nays: None
