October 26, 1976 <br /> <br /> WHEREAS, the applicant and the Planning DireCtor have done all things required to <br />be done in connection with said application and the Planning Commission has recommended <br />the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> (a) That the Use for which the use permit hereinafter described is sought: (I) <br />Will not adversely effect the health or safety of persons residing or working in the neighbor- <br />hood of the proposed use; (2) Will not be detrimental to the public welfare or injurious <br />to property or improvements in the neighborhood; and, (3) Will be in accord with the purposes <br />of the Zoning Chapter of the City Code. <br /> <br /> (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40- <br />78[b} of the City Code to operate a home for the aged on the property described as follows: <br /> <br /> Beginning at the northeast corner of Fifth Street and Portsmouth Boulevard; <br />~hence east along Portsmouth Boulevard approximately 150' to a side lot line; <br />%h~Rce north approximately 125' to a point; thence west approximately 150' to the <br />east right-of-way line of Fifth Street; thence south along said right-of-way <br />~proximately 125' to Portsmouth Boulevard, to the point of origin. <br /> <br /> (c) The granting of this use permit is subject to the following condition: Complying <br />with all requirements and receiving all permits from the State and City." <br /> <br />Ayes.' Barnes, Early, Elliott, Holley, Oast, Davis <br />Nays: None <br /> <br /> 76-404 - On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution <br />~pproved on first reading at the Public Hearing meeting of October 11, 1976, was adopted, and <br />by the following vote: <br /> <br />(g) <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO OPERATE A GASOLINE SERVICE STATION ON <br />CERTAIN PROPERTY SITUATE NEAR THE INTERSECTION OF HODGES FERRY ROAD AND <br />PORTSMOUTH BOULEVARD. <br /> <br /> WHEREAS, Southland Corporation has made an application pursuant to Section 40-70(b) <br />of the Code of the City of Portsmouth, Virginia, 1973, for the granting of a use permit <br />as hereinafter described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things required to <br />be done in connection with said applicationn and the Planning Commission has recommended <br />the granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> (a) That the use for which the permit hereinafter described is sought: (1) Will <br />not adversely effect the health or safety of persons residing or working in fhe neighbor- <br />hood of the proposed use; (2) Will not be detrimental to the public welfare or injurious <br />to property or improvements in the neighborhood; and [3) Will be in accord with the purposes <br />of the Zoning Chapter of the City Code. <br /> <br /> (b) The Cityof Portsmouth is hereby granting a use permit pursuant to Section 40- <br />70(b) of the City Code to operate a gasoline service station on the property described <br />as follows: <br /> <br /> Beginning at the southeast corner of Hodges Ferry Road and Portsmouth <br />Boulevard; thence southerly along the east side of Hodges Ferry Road approxi- <br />mately 115' to a side property line; thence easterly along .said line approximately <br />184' to a point; thence northerly approximately 110' to the south right-of-way <br />line of Portsmouth Boulevard; thence westerly along said right-of-way approximately <br />159' to Hodges Ferry Road, the point of origin. <br /> <br />(c) The granting of this use permit is subject to the following condition: <br /> <br /> That petitioner shall construct all improvements per site plan prior to his petition <br />for a use permit." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Davis <br />Nays: None <br /> <br /> 76-404 On motion of Mr. Early and seconded by Mr. Elliott, the following ordinance <br />approved on first reading at the Public Hearing meeting of October 11, 1976, was adopted, and <br />by the following vote: <br /> <br />(i) <br /> <br />"AN ORDINANCE TO ~END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING AND REORDAINING SECTION 40-71(b)OF SAID CODE PERTAINING TO <br />THE USES WHICH ARE PERMITTED WITHIN THE COMMERCIAL C-2 DISTRICT UPON THE <br />GRANTING OF A USE PERMIT." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Davis <br />Nays: None <br /> <br /> <br />
