<br />Areas Of The City Of Portsmouth", a copy of said plat is attached hereto.

<br /> On motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution was adopted

<br />"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br />OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO C}~PTER
<br />471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br />THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF THE BEACON ROAD AND BLLIOTT
<br />STREET PROJECT.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary 6o acquire interests hereinafter
<br />specified in and to the hereinafter described parcel of land situate in the City of Portsmout!
<br />Virginia, for the purpose of constructing,~altering and maintaining the Beacon Road and Ellio
<br />Street Project; and
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase property described herein,
<br />necessary to the project, because the owners thereof in the City have not been able to agree
<br />upon price to be paid therefor; and
<br />
<br /> WHEREAS, advancement of the work and use of the said project will be delayed unreasonabl'
<br />if said property is not made available as soon as possible.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of PortsmOuth, Virginia:
<br />
<br /> 1. The City Attorney is directed to institute eminent domain proceedings against the
<br />following property situated in the City of Portsmouth, for the purpose of acquiring fee' simp1
<br />title therein, together with any and all easements of access, light or air incident to the
<br />lands of the landowner abutting upon said property, in accordance and pursuant to Sections
<br />2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of
<br />Assembly of 1970, as'amended), and to deposit to the credit of the Clerk of the Circuit Court
<br />of the City of Portsmouth as provided by law the sum hereinafter stated to compensate the
<br />owners of the parcel of land designated as Parcel 6 on the plat entitled, "Plat Showing SO
<br />Foot Storm Sewer Easement Acquired For Drainage Improvements To Various Areas Of The City
<br />Of Portsmouth", a copy of said plat is attached hereto.

<br />2. The name of the property owner is: Leon F. and Edith R. Houston."
