<br />Condemn property belonging to Robert P. and

<br />Elliott, the following resolution wasaadopted,

<br /> On motion of Mr. Wentz and seconded by Mr.
<br />and by the following vote:
<br />
<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY
<br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER
<br /> 471 OF THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br /> THE CONSTRUCTION, ALTERATION AND MAINTENANCE OF DEEP CREEK BOULEVARD.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire interests hereinafter ~
<br />specified in and to the hereinafter described parcel of land situate in the City of Portsmoutt
<br />Virginia, for the purpose of constructing, altering and maintaining Deep Creek Boulevard; amd
<br />
<br /> WHEREAS, the City of Portsmouth has not been able to purchase property described herein,
<br />necessary to the project, because the owners thereof in the City have not been able to agree
<br />upon price to be paid therefor; and
<br />
<br /> WHEREAS, advancement of the work and use of the said project will be delayed unreasonabl
<br />if said property is not made available as soon as possible.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> 1. The City Attorney is directed to institute eminent domain proceedings against the
<br />following property situated in the City of Portsmouth, for the purpose of acquiring fee simple
<br />title therein, together with any and ali easements of access, light or air incident ~o the
<br />lands of the landowm~rabutting upon said property, in accordance and pursuant to Sections
<br />2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Asse~
<br />of 1970, as amended), and to deposit to the credit of the Clerk of the Circuit Court of the
<br />City of Portsmouth as provided by law the sum hereinafter stated to compensate the owners
<br />of the parcel of land designated on that certain plat entitled, "Plat of Deep Creek Boulevard
<br />Street Improvement, Des Moines Avenue to Wright Avenue", a copy of said plat is attached
<br />hereto.

<br />2. The name of the property owner is: Robert P. and Grace E. Thompson."
<br />
<br /> Ayes: Barnes, Early, Elliott, Hotley, Oast, Wentz, Davis
<br /> Nays: None
<br />
<br /> 76-446 - "Consideration of a resolution to

<br /> On motion of Mr. Wentz and seconded by Mr.
<br />and by the following vote:

<br />condemn property belonging to Jessie A. and
<br />
<br />Elliott, the following resolution was adopted,
<br />
