The name of the property owner is: Prank J. <br /> <br />and Darlene N. Nagy, Jr." <br /> <br /> Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br /> Nays: None <br /> 76-441 - "Consideration of a resolution to condemn property belonging to William H. / <br />and Charlotte A. Lewis." <br /> On motion of Mr. Wentz,seconded by Mr. Elliott, the following resolution was adopted,and y <br />v°te:"A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY BY THE CITY <br /> OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO CHAPTER <br /> 471 OP THE ACTS OF ASSEMBLY, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR <br /> THE CONSTRUCTION, ALTERATION AND 5~INTENANCE OF THE BEACON ROAD AND ELLIOTT <br /> STREET PROJECT. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary to acquire interests hereinafter j <br />specified in and to the hereinafter described parcel of land situate in the City of PortsmoutH, <br />Virginia, for the purpose of constructing, altering and maintaining the Beacon Road and <br />Elliott Street Project; and <br /> <br /> WHEREAS, the City of Portsmouth has not been able to purchase property described herein, <br />necessary to the project, because the owners thereof in the City have not been able to agree <br />upon price to be paid therefor; and <br /> <br /> WHEREAS, advancement of the work and use of the said project will be delayed unreasonably <br /> if said property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. The City Attorney is directed to institute eminent domain proceedings against the <br />following property situated in the City of Portsmouth, for the purpose of acquiring fee <br />simple title therein, together with any and all easements of access, light or air incident <br />to the lands of the landowner abutting upon said property, in accordance and pursuant to <br />Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the <br />Acts of Assembly of 1970, as amended), and to deposit to the credit of the Clerk of the <br />Circuit Court of the City of Portsmouth as provided by law the sum hereinafter stated to <br />compensate the owners of the parcel of land designated as Parcel ~ on the plat entitled, <br />"Plat Showing 30 Poor Storm Sewer Easement Acquired Pot Drainage Improvements To Various <br />Areas Of The City Of Portsmouth", a copy of said plat is attached hereto. <br /> <br /> 2.
