<br /> 77-26 - "Consideration of an ordinance to amend the City Code pertaining to increased
<br />sewage treatment charges for areas outside the City of Portsmouth;and, increasing the rate
<br />for sePtic tank disposals..
<br />
<br /> The Hampton Roads Sanitation District Commission has increased the rates charged for
<br />treatment of sewage for all areas served by the Hampton Roads Sanitation District, This
<br />amendment will permit the City of Portsmouth to charge the same rates, in areas outside the
<br /> City limits where the City of Portsmouth provides sewer treatment services~ Also, Hampton
<br />Roads Sanitation has increased its dump.fees for septic tank trucks. This amendment will
<br />permit the City of Portsmouth to parallel Hampton Roads Sanitation on this fee. I would like
<br />to re-emphasize that this change does not affect any of the citizens living in the pre-1968
<br />boundaries. However, those residents in the Churchland area who are served by the Hampton
<br />Roads Sanitation District Commission will be receiving an increase from Hampton Roads.. The
<br />City Manager recommends adoption."

<br /> On motion of Mr. Halley and seconded by Mr. Elliott, the following ordinance was adopted
<br />on first and final reading, and by the following vote:
<br />
<br /> "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, t973,
<br /> BY AMENDING SECTIONS 38-77(b) PERTAINING TO CHARGES FOR CUSTOMERS OUTSIDE
<br /> OF THE CITY OF PORTSMOUTH; AND SECTION 38-79 PERTAINING TO CHARGE FOR TRUCK-
<br /> HAUL WASTE FROM SEPTIC TANKS."

<br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis

<br />
<br /> 77-27 "Consideration of a resolution appointing viewers for the closing of a portion
<br />of Freedom Avenue.
<br />
<br /> The City of Portsmouth has applied to close a portion of Freedom Avenue, bounded on
<br />the west by Cavalier Boulevard and on the east b~ Victory Boulevard. This resolution will
<br />appoint viewers pursuant to State law to make a recommendation to City Council. The City
<br />Manager recommends adoption."

<br /> On motion of Mr. Elliott and seconded by Mr. Wentz, the following resolution was adopted~
<br />and by the following vote:
<br />
<br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING THE FOLLOWING STREET: A PORTION
<br />OF FREEDOM AVENUE LOCATED BETWEEN CAVALIER BOULEVARD ON THE WEST AND VIKING
<br />STREET ON THE EAST. (S-77-1).

<br /> WHEREAS, the City of Portsmouth has made application to vacate and close the hereinafter
<br />described portion of a certain street, and it appearing that notice was duly posted January
<br />4, 1977, on the bulletin board of the Circuit Court of the City of Portsmouth, the bulletin
<br />board of the City Council Chamber of the City of Portsmouth and the bulletin board of the
<br />General District Court, Civil Division of the City of Portsmouth, Virginia.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that Frank N. Bilisoly, Reverend J. R. Wilkerson, A. N, Kendrick, R. Irvlne Smith, and H.
<br />L. Davis be appointed viewers to view the hereinafter described portions of such street
<br />and to report to this Council in writing whether in their opinion, any and if any, what
<br />inconvenience would result in vacating and closing the following:
<br />
<br />FREEDOM AVENUE
<br />
<br /> Beginning at the northeast corner of Cavalier Boulevard and Freedom Avenue;
<br />thence running along Freedom Avenue in an easterly direction 500 feet to a
<br />point; thence running along Viking Street in a southerly direction 60 feet
<br />to a point; thence running along Freedom Avenue in a westert¥ direction
<br />514.67 feet to a point; thence running along Cavalier Boulevard in a
<br />northerly direction 60 feet to the point of beginning.

<br /> Said portion to be closed, also described as all that certain piece, parcel
<br />of land or street lying and being in the City of Portsmouth, Virginia, known
<br />as Freedom Avenue located between Cavalier Boulevard on the West and Viking
<br />Street on the East.'!

<br />
<br /> 77-28~- "Consideration of a resolution authorizing the State Department of Highways and
<br />Transportation to acquire a right-of-way for construction of the Western Freeway Extension
<br />from the Midtown Tunnel to the Western Branch of the Elizabeth River.
<br />
<br /> This resolution authorizes the State Highway Department to proceed with advanced right-
<br />of-way acquisitions on properties that become available that are known to be within the
<br />boundaries of the Western Freeway Extension between the new bridge and the Midtown Tunnel.
<br />This resolution is a standard resolution furnished by the State that requires adoption by
<br />local governing bodies prior to any advance acquisition; and, also commits the City,to its
<br />15% share of this right-of-way. The City Manager recommends adoption."
