122 <br /> <br />.~mmrv 25: 1977 <br /> <br /> On motion of Mr. Early and seconded by Mr. Elliott, the following resolution was adopted, <br />and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE STATE HIGHWAY AND TRANSPORTATION COmmISSIONER TO <br /> ACQUIRE RIGHT OF WAY FOR THE CONSTRUCTION OF T~ WESTERN FREEWAY EXTENSION <br /> FROM THE MIDTOWN TUNNEL TO THE WESTERN BRANCH OF THE ELIZABETH RIVER; AUTHORI2ING <br /> TO REIMBURSE THE STATE ttIGHWAY DEPARTMENT FOR FIFTEEN PERCENT (15%) OF ALL COSTS <br /> INCURRED. <br /> <br /> WHEREAS, Section 53.1-89 of the Code of Virginia, as amended by the 1970 session <br />of the General Assembly, authorizes the State Highway & Transportation Commissioner to <br />acquire rights of way for the construction, reconstruction, alteration, maintenance and <br />repair of public highways within municipalities on projects which are constructed with <br />State or Federal participation; and <br /> <br /> WHEREAS, Section 33.1-89, as amended, further provides that the State Highway & Transpor- <br />tation Commissioner may exercise such authority only upon receipt of official request <br />from the city or to~m involved, now <br /> <br /> THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />it hereby requests the State Highway & Transportation Commissioner to acquire the necessary <br />right of way for the Western Freeway Extension, Project 0164-124-105, PE-101 within the <br />Corporate Limits of the City of Portsmouth and guarantees to reimburse the State Highway <br />& Transportation Department for fifteen percent (13%) of all costs incurred in the acquisition <br />of such rights of way, and it is understood that such acquisitions will be handled by <br />the Commissioner under established policies and procedures; and his decision in all instances <br />shall be final." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 77-Eg~-~"Consideration of an ordinance amending Section 58-43 of the City Code pertainingl <br />to new account fees and adding a section thereto pertaining to transfer fees. <br /> <br /> Section 38-43 of the City Code now establishes a new account fee when a customer applies <br />for initial service; or, when a customer moves from one residence to another within the City. <br />The current fee is $7.S0 for new service or transfer. The recdmmended change to the Code will <br />establish a fee of $75.0 for initial water service which <br />account and turning on the water at the new address. However, it ~ill add'a section where an <br />existing customer, when moving from one residence to another within the City, will pay a lowe~ <br />fee of $5.00, which will include transferring the account and turning on the water at the new <br />address. Our data processing system has recently been improved to allow transfer data from <br />one account to 'another while maintaining financial controls; thereby, eliminating consider- <br />able paperwork which in turn justifie~ the reduced fee on transfers. The City Manager recom- <br />mends adoption." <br /> <br /> On motion of Mr. Wen~z and seconded by Mr. Holley, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CO~E OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br />AMENDING SECTION 38-45 THEREOF, PERTAINING TO FEES FOR ~gTABLISHING ACCOUNTS." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br />77-50 - "Presentation by the City Manager's staff on the Clean City Program." <br /> <br /> Mr. Ellis B. Hilton, Director of Public Works, presented film titled "Keep America <br />Beautiful". <br /> <br /> Mr. C. H. McGinnia, Assistant City Manager, <br />City be allowed to file official application. <br /> <br />and <br /> <br />made presentation and requested that the <br /> <br />On motion of Mr. Barnes and seconded by Mr. Oast, the following resolution was adopted, <br />by the following vote: <br /> <br /> "A RESOLUTION ENDORSING THE KEEP AMERICA BEAUTIFUL INCORPORATED PROGRAM AND <br /> AUTHORIZING T~ CITY MAnaGER TO SUBMIT AN OFFICIAL APPLICATION SO T}~T THE CITY <br /> OF PORTSMOUTH MIGHT BE SELECTED AS A PARTICIPANT IN SUCH PROGRAM. <br /> <br /> WHEREAS, the City of Portsmouth desires to improve its appearance and enhance its <br />natural beauty; and <br /> <br /> WHEREAS, it is felt that such action is encumbant upon the City as a recent All America <br />City Award winner; and <br /> <br /> WHEREAS, Keep ~dmlerica Beautiful Incorporated offers one Of the most comprehensive <br />programs known to effect such an action. <br /> <br /> THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />it endorses the Keep America Beautiful Incorporated Program. <br /> <br /> <br />
