The City Manager recommends adoption on first reading." · <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Holley, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, <br />BY AMENDING SECTION 20-81(a) THEREOF, PERTAINING TO DETECTIVE AGENCIES AND <br />WATCHMEN." <br /> <br /> 77-45 "Consideration of an ordinance to amend Section 33-56 of the City Code pertainin <br />to off-site drainage. <br /> <br /> The changes that are included in this amendment are in accordance with recommendations <br />which were made to the City Council at our last meeting. The City Attorney has drafted the <br />necessary changes to amend the Code in the categories of residential, commercial, and indus- <br />~rial properties. ,The major change which is included in this amendment is the elimination <br />of the assessment for off-site drainage. However, certain restrictions have been built-in <br />from a safety standpoint which could cause drainage to be installed in order for building <br />permits to be issued. The City Manager recommends adoption." <br /> <br />Rev. Thornton Frye, Pastor of Biltmore Baptist Church, spoke representing the Church. <br /> <br /> On motion of Mr. Oast and seconded by Mr. Early, the following ordinance was adopted on <br />firs% and ffn~l r~adi~g~ and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY <br />AMENDING SECTION 33-S6 THEREOF~ PERTAINING TO OFF-SITE DRAINAGE." <br /> <br />Ayes: Early, <br />Nays: Barnes <br />Abstaining: Hotley <br /> <br />Elliott, Oast, Wentz <br /> <br /> 77-46 "Consideration of an ordinance to close a portion of Freedom Avenue located <br />between Cavalier Boulevard and Viking Street on the east. <br /> <br /> A resolution wa~ adopted by City Council on January 25, 1977 appointing viewers for a <br />portion of Freedom Avenue. A copy of their report ~s attached for your information. Also, <br />a plat outlining the proposed street to be closed is attached for your information. The <br />closing of this street was petitioned by the City in connection with the purchase of the open <br />space land in Cavalier Manor in order that we may fully develop the entire parcel into a rec- <br />reational complex. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF FREEDOM AVENUE LOCATED <br />BETWEEN CAVALIER BOULEVARD ON THE WEST AND VIKING STREET ON THE EAST. (S-77-1)." <br /> <br />Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz <br />Nays: None <br /> <br /> 77-47 Consideration of a resolution authorizing the Portsmouth School Board to make <br />application to the State for a State Literary Loan in the amount of $1,200,000 towards con- <br />struction costs on the James Hurst Elementary School. <br /> <br /> Funds have already been appropriated for the architectural and engineering design fees <br />for the James Hurst Elementary School. This authorization is needed in order that the gchool <br />Board may make application for $1,200,000 in literary loans available from the State for <br />school construction. The City has always encouraged the application for literary loans <br />where possible due to the low interest rates that would be afforded us for construction. A <br />copy of the letter from the School Board requesting this authorization is attached for your <br />information. The City Manager recommends adoption." <br /> <br /> <br />
