142 <br /> <br />February 22~ 1977 <br /> <br /> WHEREAS, Seaboard Coastline Railroad Company has agreed to permit the construction of <br />said access road pursuant to the terms of a license agreement. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the Council approves a license agreement between the City of Portsmouth and Seaboard Coastline <br />Railroad Company for the construction and maintenance of a private access road across the <br />main line of said railroad. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to enter <br />into said agreement." <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Davis <br />Nays: None <br /> <br /> 77-69 - "Consideration of a resolutio~:~atifying the authorization previously made <br />for the City to apply to the Environmental Prot;ection Agency for Federal funds to cons~truct <br />waste water treatment facilities. ~ : ''- ' <br /> <br /> This ~esolution is a ratification of a previous resolution authorizing the City Manager <br />and the Director of Public Utilities to do whatever is necessary to apply for such grant. <br />This resolution changes the Director of Public Utilities from P. J. Brady to J~,A. Howell, Jr <br />The Cit~yManager recommends adoption." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Oast, the following resolution was adopted, <br />and by the following vote: <br /> <br /> "A RESOLUTION RATIFYING THE AUTHORIZATION PREVIOUSLY MADE FOR THE CITY TO APPLY <br /> TO THE ENVIRONMENTAL PROTECTION AGENCY FOR FEDERAL FUNDS TO CONSTRUCT WASTE WATER <br /> TREATMENT FACILITIES; AUTHORIZING THE CITY ~NAGBR AND DIRECTOR OF PUBLIC UTILITIES <br /> TO DO WHATEVER IS NECESSARY TO APPLY FOR SUCH GRANT. <br /> <br /> WHEREAS, on October :28, 1975, Council authorized R, T. Willia. ms,,City Manager and P. <br />J. Brady, former Direc~tor of Public Utilities, to sign an application for federal funds for <br />the construction of waste water treatment facilities; and <br /> <br /> WHEREAS, application is now being made for Phase II of the plan for.the:construction <br />of waste water treatment facilities. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />Council ratifies the aut. horization granted on October 28, 1975, to apply for federal funds <br />from the Environmental Protection Agency to construct waste Wat~D:tre&tmCnt facilities. <br /> <br /> BE IT FURTHER RESOLVED that R. T. Williams, City Manager, and J. A. Howell, Jr., Director <br />of Public Utilities are authorized to do whatever is necessary to apply for federal grants <br />for the construction of waste water treatment facilities." <br /> <br /> Ayes: Barnes, Early, Elliott, Oast, Davis <br /> Nays: None <br /> <br /> 77-70 - "Consideration of a resolution approving a group housing project pursuant to the <br />City Code, for a project known as 'Effingham Project, Elderly and Handicapped Housing', and <br />designated as GHP 77-2; and, authorizing the issuance of a group housing permit. <br /> <br /> This resolution approvesa group housing project and authorizes the issuance of a group <br />housing permit for the elderly and handicapped. The project consists of 178 dwelling units <br />in two 4-story buildings on approximately 6.7 acres. A copy of the letter from the Planning <br />Commission recommending issuance of the permit is attached for your information. The~City <br />Manager recommends adoption." <br /> <br /> Dan E. Griffin, Architect for the Project, spoke about the unusual protection for the <br />elderly. <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following~resolution'was adopted <br />and by the following vote: ~ <br /> <br /> "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION <br /> 40-55 OF THE CODE OF THE CITY OF;PORTSM8UTH,!1973, AS AMENDED, SUCHPROJECT.BE~NG <br /> KNOWN AS "EFFINGH;uM PROJECT, ELDERLY AND HANDICAPPED HOUSING"~AND DESIGNATED AS <br /> GHP-77-2. <br /> <br /> WHEREAS, Portsmouth Redevelopment And Housing Authority has made application pursuant <br />to Section 40-55 of the Code of the City of Portsmouth, Virginia, 1973, as amended, for the <br />granting and approval of a Group Housing Project kno~m as "Effingham Project, Elderly And <br />Handicapped Housing" (GHP-72-2); and <br /> <br /> %%~EREAS, the application for same has been determined by the Planning Commission to admil <br /> the requirements of Section 40-55 except as hereinafter stated; and <br /> <br /> W~EREAS, the Planning Commission has reviewed such application and the site-plans submit1 <br /> therewith and has recommended approval of said application subject to the conditions hereinaf~ <br /> stated; and <br /> <br />ed <br /> <br /> <br />
