141 <br /> <br />Fehyuary 22+ 1~77 <br /> <br /> WHEREAS, the Southern Railroad, Seaboard Coastline Railroad, Norfolk and Western Railway <br />and Norfolk-Franklin and Danville Railroad have petitioned the Southern Freight Association <br />for an increase of freight rates for aggregate delivered in the Portsmouth, Virginia area; <br />and <br /> <br /> WHEREAS, said proposed ~increase in freight rates would directly affect the City of <br />Portsmouth by increasing maintenance cost and the cost of capital projects through an increas~ <br />in the cost of both bulk purchases and bid prices from project contractors; and <br /> <br />WHEREAS, since 1972 said rates have increased from $1.45 to $2.42 or 67%; and <br /> <br /> WHEREAS, the current proposed increase for 1977 would raise the rates 27% from $2.42 <br />to $5.08. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the City Council expresses its objection to the petition of Southern Railroad, Seaboard <br />Coastline Railroad, Norfolk and Western Railway and Norfolk-Franklin and Danville Railroad <br />for an increase in freight rates on various aggregate including sand, crushed stone and <br />gravel. <br /> <br /> BE IT FURTHER RESOLVED that the City Clerk be, and he hereby is, instructed to forward <br />a copy of this Resolution to the Southern Freight Association, Room C, 151 Ellis Street, <br />N. E., Atlanta, Georgia and to the State Corporation Commission, Blanton Building, Richmond, <br />Virginia." <br /> <br />Ayes: Early, <br />Nays: None <br />Abstaining: Oast <br /> <br />Elliott, Davis <br /> <br />Councilman Jack P. Barnes entered the Council'Chamber at 8:10 p.m. <br /> <br /> 77-67 - "Consideration of a resolution approving an easement for the Seaboard Coastline <br />Railroad in conjunction with improvements to the intersection of Airline and Victory Boule- <br />vards. <br /> <br /> This resolution approves an easement agreement between the City of Portsmouth and the <br />Seaboard Coastline Railroad Company in conjunction with the City of Portsmouth's desire to <br />widen and relocate the Victory Boulevard railroad grade crossing at the intersection of <br />Airline and Victory Boulevards. The City Manager recommends adoption." <br /> <br /> On motion of Mr. Early and seconded by Mr. Oast, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPROVING AN EASEMENT AGREEMENT WITH THE SEABOARD COAST LINE <br />RAILROAD COMPANY IN CONJUNCTION WITH IMPROVEMENTS TO THE INTERSECTION OF <br />AIRLINE AND VICTORY BOULEVARD; AUTHORIZING THE CITY MANAGER AND CITY CLERK <br />TO EXECUTE SUCH DOCUMENTS AS MAY BE NECESSARY TO COMPLETE SUCH AGREEMENT. <br /> <br /> WHEREAS, the City of Portsmouth desires to widen and relocate the Victory Boulevard <br />railroad grade crossing at the intersection of Airline and Victory Boulevards; and <br /> <br /> WHEREAS, the Seaboard Coast Line Railroad Company has agreed <br />the street crossing at grade across the right of way and track or <br />Line Railroad Company. <br /> <br />to gyant an easement for <br />tracks of Seaboard Coast <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City. of Portsmouth, Virginia, <br />that the easement agreement with~the Seaboard Coast Line Railroad Company in conjunction <br />with improvements to the intersection of Airline and Victory Boulevard is hereby approved. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager and the City Clerk are hereby .authorized <br />to execute such documents as may be necessary to complete such agreement.'.' <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Davis <br />Nays: None <br /> <br /> 77-68 "Consideration of a resolution approving a license agreement between the City <br />of Portsmouth and the Seaboard Coastline Railroad Company for the construction and maintenanc~ <br />of a private access road across the main line of said railroad. <br /> <br /> This resolution authorizes the City Manager to enter into a license agreement with the <br />Seaboard Coastline Railroad Company for the construction and maintenance of an access road <br />at the 12 mile post across the main line of said railroad. The City Manager recommends <br />adoption." <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was adopte, <br />and by the following vote: <br /> <br /> "A RESOLUTION APPROVING A LICENSE AGREEMENT BETWEEN THE CITY OF PORTSMOUTH <br /> AND SEABOARD COASTLINE RAILROAD C!0MPANY FOR THE CONSTRUCTION AND MAINTENANCE <br /> OF A PRIVATE ACCESS ROAD ACROSS THE MAIN LINE OF SAID RAILROAD; AUTHORIZING <br /> THE CITY bIANAGER TO ENTER INTO SAID LICENSE AGREEMENT. <br /> <br /> ? <br /> WHEREAS, the City of Portsmouth desires to construct and maintain a private access <br />road across the main line of Seaboard Coastline Railroad Company; and <br /> <br /> <br />
