<br /> WHEREAS, the developer has been informed that approval of the Group Housing Project
<br />pursuant to said Section 40-55 of the Code of the City of Portsmouth, Virginia, grants
<br />only an exemption from certain dimensional requirements for residences as stated in said
<br />Section 40-55 and does not constitute a waiver of any other requirements embodied in the
<br />Subdivision Ordinance, Zoning Ordinance, the Cdde of the City of Portsmouth and any other
<br />applicable state or federal laws; and
<br />
<br /> WHEREAS, the developer is aware that building permits and/or any other required permit
<br />will be issued only upon compliance with ordinances or laws applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the certain Group Housing Project known as 'Effingham Project, Elderly And Handicapped
<br />Housing* and designated as GHP-77-1, and more specificall7 shown on a plat entitled,
<br />'Proposed Elderly Housing For The Portsmouth Redevelopment And Housing Authority, Effingham
<br />Project', dated February, 1977, prepared by Dan E. Griffin."

<br /> Motion of Mr. Oast and seconded by Mr. Barnes, the report to be received as information
<br />was adopted by unanimous vote.
<br />
<br /> 77-55 -~PReport from the City Manager on a request for a drainage easement at Turlingto]
<br />Park near Lake Speight."
<br />
<br /> "In response to Council's request to investigate the matter brought before it at the
<br />last Council meeting by Mr. James W. Jones, Attorney-at-Law, representing the VSB Company,
<br />developers of Lake Speight Run Colony and Turlington Park in the City of Suffolk; we have
<br />met with Mr. Jones and VSB's engineer has met with the City's legal and Public Utilities
<br />staff. The City staff has determined that the drainage easements sought by VSB to replace
<br />the revocable permits already authorized by City Council can be granted without increasing
<br />the present danger to the City's watershed.
<br />
<br /> However, as you may recall, City Council has twice requested the City of Suffolk formall
<br />to take action on abating and protecting the watershed thrgugh appropriate City ordinances
<br />and the upgrading of Suffolk's near~y sewage pumping station which at times has malfunctioned
<br />and caused raw sewage to be discharged directly into the City's watershed. These notifica-
<br />tions were addition to numerous formal and informal requests on the part o~, this office. To-
<br />date we have not received a response on this subject. Therefore, it is my Te~ommendation tha'
<br />the City Council grant the required easements subject to the approval of the Director of the
<br />Department of Public Utilities and that I be authorized to notify the Suffolk CityS~anager
<br />and appropriate Dep~rtment of Highways and Transportation officials that the City of Ports-
<br />mout~ will no longer consider subdivision related requests for drainage easements across City
<br />watershed property until such time as the City of Suffolk has taken sufficient action to
<br />abate the problems cited above."

<br /> James W. ~ones, Attorney, representing VSB Company, was available to answer questions
<br />regarding the matter.
<br />
<br /> On motion of Mr. Early and seconded by Mr. Elliott, the following resolution was adopted
<br />and by the following vote:
<br />
<br />"A RESOLUTION APPROVING DRAINAGE EASEMENTS IN LAKE SPEIGHT COLONY AND TURLINGTON
<br />PARK SUBDIVISION OF THE CITY OF SUFFOLK SUBJECT TO APPROVAL OF THE DIRECTOR OF
<br />PUBLIC UTILITIES OF THE CITY OF PORTSMOUTH.
<br />
<br /> WHEREAS, by resolution adopted March 25, 1975, the Council Of the City of Portsmouth
<br />granted a revocable permit for storm drainage to Lake Speight Colony; and
<br />
<br /> WHEREAS, by resolution adopted January 17, 1977, the Council of the City of Portsmouth
<br />granted a revocable permit for storm drainage to Turlington Park; and
<br />
<br /> WHEREAS, the Virginia Department of Highways and Transportation has advised that it
<br />will not accept dedication of the streets in the aforesaid subdivisions with a revocable
<br />drainage easement; and
<br />
<br /> WHEREAS, despite repeated requests by the City of Portsmouth, the City of Suffolk
<br />has failed to upgrade its sewage pump station located in the vicinity of the aforesaid
<br />subdivision or to take other measures to correct the problem of discharge into the Portsmouth
<br />watershed.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that an easement for storm drainage be, and the same hereby is, approved as designated
<br />on those certain plats entitled, "Plat Showing Drainage Easements To Be Conveyed to V.S.B.
<br />Company, A Partnership, By The City Of Portsmouth", dated November 1S, 1976, prepared by
<br />Rouse-$irine Associates, Ltd. and "Subdivision Of Lake Speight Colony, Holy Neck Borough,
<br />Suffolk, Virginia," dated 1974, prepared by,l~s~=~Lirse Associates, Limited, subject to
<br />approval by the Director of Public UtilitieS~b~'~6rtsmouth.
