June 8, 1999 Recommendation: · Adoption of a resolution authorizing the City Manager to execute a purchase agreement with the Virginia Department of Transportation (VDOT) providing for the conveyance of city-owned properties to the Commonwealth for use in the construction of an interchange at the Midtown Tunnel, and providing further authority for the execution of deeds and other documents. Purpose and Need: · The Commonwealth has begun assembling properties necessary for the construction of an interchange at the Midtown Tunnel and has forwarded the purchase agreement to the City for execution. · The properties to be conveyed include the Pinners Point Fire Station, the former Pinners Point Sewage Treatment Plant, and a parcel of land adjacent to the former Nissan site. (See maps attached). · The agreement will provide that the City may continue to use the Pinners Point Fire Station until November 1, 2000. Financial Impact: · The purchase agreement provides that the Commonwealth will pay the City of Portsmouth $1,250,000 for the properties, along with such additional compensation as is required to provide a functional replacement for the Pinners Point Fire Station, the plans for which have been approved by VDOT. Motion by Mr. Benn, and seconded by Mr. Whitehurst, to adopt the following resolution, and was adopted by the following vote: "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A PURCHASE AGREEMENT TO CONVEY THE PINNERS POINT FIRE STATION AND TWO OTHER PARCELS OF LAND TO THE COMMONWEALTH OF VIRGINIA (VIRGINIA DEPARTMENT OF TRANSPORTATION), AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE DEED(S) OF CONVEYANCE FOR SAID PROPERTIES TO THE COMMONWEALTH OF VIRGINIA AS MAY BE APPROPRIATE. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to enter into a Purchase Agreement with the Commonwealth of Virginia, acting through the Virginia Department of Transportation, that will provide that the City of Portsmouth is to convey to the Commonwealth of Virginia the Pinners Point Fire Station and two other parcels of land, necessary to the construction of an additional tube and interchanges at the Midtown Tunnel, said lands being described as follows, to-wit: All that certain piece, or parcel of land, with the buildings and improvements thereon, situate in the City of Portsmouth, Virginia, being designated as Parcel 064, as shown on Sheets 8 and 25 of the plans for Route 164, State Highway Project 0164-124- FO4, RW-201, and beginning on the west (left) side of the construction centerline of Ramp C at the existing right of way of Cleveland Street at approximate State 44+15 to the lands now or formerly owned by the Commonwealth of Virginia through its Virginia Port Authority at approximate Station 46+28, being 0.782 acres, more or less. All that certain piece, or parcel of land, situate in the City of Portsmouth, Virginia, being designated as Parcel 048, as shown on Sheets 20 and 21 of the plans for Route 164, State Highway Project 0164-124-FO4, RW-201, and beginning on the west (left) side of Route the 58, westbound (WB) construction centerline at the lands owned by the Commonwealth of Virginia, at approximate Station 75+70 to the lands now or formerly owned by the Commonwealth of Virginia through its Virginia Port Authority at approximate Station 83+75, being 9.2823 acres, more or less.
