156 March 22, 1977 On motion of Mr. Barnes first and final reading, and and seconded by Mr. Early, by the following v~te: the following ordinance was adopted on "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY AMENDING SECTION 33-56 THEREOF, PERTAINING TO OFF-SITE DRAINAGE." Ayes: Barnes Nays: None Abstaining: Holley , Early, Elliott, east, Wentz, Davis 77-94 "Consideration of an ordinance closing a portion of Thomas Avenue east from the centerline of BoOker Street to the center of Scotts Creek, a distance of approximately 210'. A resolution was adopted on March 8, 1977, appointing viewers pursuant to the State Code. A copy of the viewers report and a plat showing the property for closure is attached for your information. The City Manager recommends adoption." On motion of Mr. Barnes and seconded by Mr. Wentz, the following ordinance was adopted on first and final reading, and by the following vote: "AN ORDINANCE CLOSING THE FOLLOWING STREET: A PORTION OF THOMAS AVENUE; FROM THE EAST LINE OF BOOKER STREET EAST TO THE CENTER OF SCOTT'S CREEK. A DISTANCE OF APPROXIMATELY 210 FEET." Ayes: Barnes, Early, Eltiott, Holley, Oast, Wentz, Davis Nays: None 77-95 - "Consideration of a resolution granting a Use Permit to the Volunteers for America to operate a Halfway House at the Effingham YMCA. At the Council meeting on March 8, the City Council established the definition of a half- way house; and created the requirement for a Use Permi~ in certain areas of the City. This re~ solution authorizes a Use Permit to Volunteers fdr America to operate a Halfway House at the Effingham YMCA. The City Manager recommends adoption." On motion of Mr. Barnes and seconded by Mr. Holley, the following resolution was .o~j~i~s©.~.eA~i~:,-2.1and.~g~he following vote: "A RESOLUTION GRANTING A USE PERMIT TO VOLUNTEERS OF AMERICA TO OPERATE A HALF-WAY HOUSE IN TF~ EFFINGF~&M YMCA. ~}IEREAS, Volunteers Of America made an application pursuant to Section 40-70(b) of the Code of the City of Portsmouth, 1973, for the granting of a use permit as hereinafter des- cribed; and IFHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and the Planning Commission has recommended the granting of said use permit. NOW, TIt~REFORE BE IT RESOLVED by the Council of the City of PortsmOuth, Virginia: (a) That the use for which the use permit hereinafter described is sought; (1) will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (2) will not be detrimental to the public use or injurious to property or improvements in the neighborhood; and (3) will be in accord with the purposes of the Zoning Chapter of the City COde. [b) The Volunteers of America are hereby granted a use permit pursuant to Section 40-79(] of the City Code to operate a Half-Way House on the property described as follows: The Effingham YMCA" Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis Nays: None . 77-96 ~ "Consideration of an ordinance to amend t~ City's Pay.i'and Classification Plan, Ordinance #76-195, metting the annual compensation for thenhewly appointed City Clerk." On motion of Mr~ Barnes and seconded by Mr. Holley, the ordinance~be:iamended setting~sal~ry at $10;500armuJlly,'and the following ordirmnce was adopted, and bY the following vOte: "AN ORDINANCE TO AMEND THE CLASSIFICATION IN THE PAY PLAN PERTAINING TO THE SALARY OF THE CITY CLERK."
