Save and except that portion of said lots lying <br />within the right of way of London Boulevard (State Route No. S8) as shown <br />on She~tgBeef the plans of Project 00S8-124-102 R/W 201 in the Department <br />of Public Works of the City of Portsmouth, Virginia. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to complete <br />all transactions and to execute all documents incident to such conveyance." <br /> <br />Ayes: Early, Elliott, Holley, Oast, ~eniz, Davis <br />Nays: None <br /> <br /> 77-155 - "Consideration of a resolutionr~equesting the State Highway Department to <br />acquire the necessary right-of-way for the extension of Victory Boulevard from Airline to <br />Portsmouth Boulevard. <br /> <br /> This resolution also commits the City to its 15% share of costs incurred through June <br />$0, 1977, and 10% of all costs incurred after that date. The City Manager recommends <br />adoption." <br /> <br /> On motion of Mr. Early and seconded bY Mr. Elliott, the following resolutiQn was adopted. <br />and by the following vote: ' <br /> <br />"A RESOLUTION REQUESTING THE STATE HIGHWAY AND TRANSPORTATION COMMISSIONER <br />TO ACQUIRE THE NECESSARY RIGHTS OF WAY FOR THE CONSTRUCTION OF THE EXTENSION <br />OF VICTORY BOULEVARD FROM AIRLINE BOULEVARD TO PORTSMOUTH BOULEVARD. <br /> <br /> WHEREAS, Section 55.1-89 of the Code of virginia, as amended by the 1970 session of <br />the General Assembly, authorizes that the State Highway and Transportation Commissioner <br />to acquire rights of way for the construction, reconstruction, alteration, maintenance <br />and repair of public highways within the municipalities on projects which are constructed <br />with state or federal participation; and <br /> <br /> WHEREAS, Section 33.1-89, as amended, further provides that the State Highway and <br />Transportation Commissioner may exercise its authority only upon receipt of official request <br />from the city involved. <br /> <br /> NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, that City <br />Council hereby requests the State Highway and Transportation Commissioner to acquire the <br />necessary rights of way for the extension of those three boulevards from Airline Boulevard <br />to Portsmouth Boulevard within the corporate limits of the City of Portsmouth and to convey <br />the title to such rights of way to the City of Portsmouth and agrees to reimburse the State <br />Highway and Transportation Department for fifteen (15%) percent of all court cos$s incurred <br />in the acquisition and conveyance of such rights of way prior to June 50, 1977, and ten <br />(10%) percent of all costs incurred in the acquisition and conveyance of such rights of <br />way after July 1, 1977; and it is understood that such acquisitions will be handled by <br />the Commissioner under established policies and procedures and his decision in all instances <br />will be final. <br /> <br /> BE IT FURTHER RESOLVED that the City Clerk is directed to forward a copy of this resolu- <br />tion to the State Highway and Transportation Commissioner." <br /> <br />Ayes: Early, Eltiott, Holley, Oast, Wentz, Davis <br />~a~s: None <br /> <br /> 77-156 "Consideration of a resolution endorsing the Solid Wast Resources Recovery <br />Implementation Plan. <br /> <br /> This resolution endorses the concept as outlined in the Implementation Plan which has <br />been distributed for your information. This resolution endorses the Solid Waste concept <br />and indicates a willingness to proceed with d~s~gn to a point where a final decision to <br />implement can be made. This resolution will also commit the City to underwrite its pro- <br />posed share of the 2.3 million ~ollars required in the design pha~in the event the project <br />is not constructed. The City's prorata share of the design phase in this event would be up <br />to a maximum of $526,000. The City Manager recommends adoption." <br /> <br />'~Thei~-~el'tcOwf~":let~r('~presented by City Manager: <br /> <br /> "On March 17, Mr. Durwood Curling, Chairman of the Southeastern Planning District <br />Commission (SVPDC) wrote Mayor Davis regarding the Resource Recovery Implementation Plan. <br />The Plan was approved by the SVPDC at its Executive Committee Meeting on March 16 and has <br />been ~Rdorsed by the Solid Waste Study Technical Committee comprised of representatives <br />f~om the SVPD jurisdictions. The SVPDC has asked for an official indication of the City's <br />continued interest and participation in the program by the end of April 1977. <br /> <br /> At this point it is important for the members of Council to have a brief summary of <br />Portsmouth's solid waste disposal operations in order that they may appreciate the City's <br />position and interest in the proposed plan. In 1965, the City built its Incinerator at <br />2005 Frederick Boulevard and in 1971, the City opened the Craney Island Landfill. The <br />Incinerator was built at a cost of $1,557,695.67, of which $561,518.00 was for financing <br />over a 20-year period. It will be totally amortized by 1985 when the new Regional Resource <br />Recovery <br /> <br /> <br />
