On motion of Mr. Early and seconded by Mr. Wentz, the following resolution was approved on first reading, and by unanimous vote: "A RESOLUTION GRANTING A USE PERMIT TO ROBERT ANDERSON TO OPERATE A JUNKYARD AT ?00 YORKTOWN AVENUE." 77-106 - The following ordinance approved on first reading at the Public Hearing meeting of April 11, 1977, was taken up and read: (f) "ZONING ~ENDMENT ORDINANCE Z 77~13'' On motion of Mr. Wentz and seconded by Mr. Elliott, the ordinance was adopted, and by the following vote: Ayes: Early, Elliott, Holley, Oast, Wentz, Davis Nays: None 77-106 - The following ordinance approve-d on~!first reading at of April 11,' 1977, was taken up and read: the Public Hearing meeting (g) "ZONING AMENDMENT ORDINANCE Z 77-15" On motion of Mr. Wentz and seconded by Mr. Etliott, the ordinance was adopted, and by following vote: theI Ayes: Early, Elliott, Holley, Oast, Wentz, Davis Nays: None 77-106 - On motion of Mr. Wentz and seconded by Mr. Elliott, the following resolution approved on first reading at the Public Hearing meeting of April 11, 1977, was adopted, and by the following vote: (i) "A RESOLUTION GRANTING A USE PERMIT TO LEROY A. AND BERTHA N. JOYNER TO OPERATE A DAY CARE CENTER ON DARREN DRIVE. (UP ?7-4) WHBREAS, LeRoy A. and Bertha N. Joyner made an application pursuant to Section 40-75(b) of the Code of the City of Portsmouth, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BB IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to property improvements in the neighborhood; and (c) Will be in accord with the purposes of the Zoning Chapter of the City Code. 40-75(b) property Roy A. and Bertha N. Joyner are hereby granted a use permit pursuant to Section of the Code of the City of Portsmouth, 1973, to operate a day care center on the described as follows: Beginning at a point on the northside of Darren Avenue approximately 572 feet east of its intersection with Nero Drive; thence easterly along the north right of way line of Darren Drive 90 feet to a side property line; thence north 190.03 feet to the rear property line; thence west 64.72 feet to a side property line; thence south 186.09 feet to the north right of way line of Darren Drive, the Point of Origin."
