As you will recall UP-77-2 was the
second part of a two part application which sought to rezone a certain parcel of property at
the terminus of Yorktown Avenue adjacent to the Seaboard-Coastline Railroad shops and yards
(see attached map) from M-1 to M-2 and to secure a use permit for the operation of an automobi
junkyard. Both of the above items were heard by the City Plagning Commission on Tuesday, Marc
t, 1977. The Planning Commission concurred with ~he application for rezoning but denied the
use permit request.

I have thoroughly reviewed the actions of the Planning Commission, applicable sections
of the State and City Codes and the site in question. I am personally satisfied that what
the applicant wishes to operate is a junkyard (automobile graveyard) and that there is nothing
extenuating aboUtt!heapplicant's circumstances which would justify a change in the City Zoning
Ordinance, nor could I determine that the administration of this City would suffer significant
consequences whether this use permit was granted or not.

However, should Council decide not to concur with the Planning Commission's recommenda-
tion, it would be my suggestion that the following stipulations be included in the requested
permit:

.e
