<br />At a regular meeting of the City Council, held on April 26, 1977, there were present:
<br />
<br />Richard J. Davis, E. Saunders Early, Jr., Archie Elliott, Jr., James W. Holley,
<br />Edward L. 0ast, Jr., Robert W. Wentz, Jr., R; T. Williams, City Manager, Gordon
<br />B. Taytoe, Jr., City Attorney.
<br />
<br />Absent: Jack P. Barnes
<br />
<br /> Rev. Henry J. Hund, Pastor, First Lutheran Church, opened the meeting with prayer, fol-
<br />lowed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Davis welcomed all visitors in attendance.
<br />
<br /> Motion of Mr. Wentz and seconded by Mr. Elliott, minutes of the Public Hearing meeting
<br />of April 11, 1977; minutes of the regular meeting of April 12, 1977, to be approved as receiv-
<br />ed, was adopted by unanimous vote.
<br />
<br /> 77-124 - Mayor Davis presented an All-America memento to Greogry Moore, Eagle Scout of
<br />Troop 225, Boy Scouts of America.
<br />
<br /> 77-125 - Motion of Mr. Wentz and seconded by Mr. Early, that Mrs. Sheila P. Pittman be
<br />appointed as Deputy City Clerk, and was adopted by unanimous vote.

<br /> 77-106 - The following ordinance approved on first reading at the Public Hearing m~eting
<br />of April 11, 1977, was taken up and read:

<br /> 77-106 - The following Use Permit application, referred from the Public Hearing meeting
<br />of April 11, 1977, was taken up and read:

<br />(e) "UP 77-2 - Petition of Robert L. & Nell I. E'well and Albert L. & Maudie W. Ferguson"
<br />
<br />The following report from the City Manager was presented:
<br />
<br /> "At your last regularly scheduled public hearing held on Monday, April 11, 1977, Counci~
<br />referred the matter of UP-77-2 to me for investigation. As you will recall UP-77-2 was the
<br />second part of a two part application which sought to rezone a certain parcel of property at
<br />the terminus of Yorktown Avenue adjacent to the Seaboard-Coastline Railroad shops and yards
<br />(see attached map) from M-1 to M-2 and to secure a use permit for the operation of an automobi
<br />junkyard. Both of the above items were heard by the City Plagning Commission on Tuesday, Marc
<br />t, 1977. The Planning Commission concurred with ~he application for rezoning but denied the
<br />use permit request.
<br />
<br /> I have thoroughly reviewed the actions of the Planning Commission, applicable sections
<br />of the State and City Codes and the site in question. I am personally satisfied that what
<br />the applicant wishes to operate is a junkyard (automobile graveyard) and that there is nothing
<br />extenuating aboUtt!heapplicant's circumstances which would justify a change in the City Zoning
<br />Ordinance, nor could I determine that the administration of this City would suffer significant
<br />consequences whether this use permit was granted or not.
<br />
<br /> However, should Council decide not to concur with the Planning Commission's recommenda-
<br />tion, it would be my suggestion that the following stipulations be included in the requested
<br />permit:
