<br /> ~H~RnAS, the application for the same has been determined by the Planning Commission
<br />to have met the requirements of Section 40-55; and
<br />
<br /> WHEREAS, the Planning Commission has reviewed such application and site plans submitted
<br />therewith and has recommended approval of said application; and
<br />
<br /> WHEREAS, the developer has been informed that approval of a group housing project
<br />pursuant to said Section 40-55 of the Code of the City of Portsmouth grants only an exemption
<br />from certain dimensional requirements for residences as stated in said Section 40-S$ and
<br />does not constitute a waiver of any other requirements embodied in the Subdivision Ordinance,
<br />the Zoning Ordinance, the Code of the Uity of Portsmouth and any other applicable state
<br />or federal laws; and
<br />
<br /> WHEREAS, the developer is aware that building permits and/or any other required permit
<br />will be issued only upon compliance with ordinance or laws applicable thereto.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the certain group housing project known as New Towne Apartments and designated as
<br />GHP-??-IR and more specifically shown on a Plat entitled, '~Southside t Housing of Last
<br />Resort", dated June 1977, prepared by Dan Griffin AIA, Ltd. and attached hereto and made
<br />a part hereof is hereby granted approval."

<br /> 77-232 - "Consideration of a resolution authorizing the City Manager to exchange property
<br />at the intersectinn of Princeton Road and Pine Valley Road.
<br />
<br /> The City Council authorized, May S1, 1977, the advertising of the City owned property as
<br />an exchange with the adjacent landoowner to the benefit of both parties. The advertisement
<br />has been completed~iwith the adjacent land owner being the successful bidder. The City Manager
<br />recommends adoption."

<br /> On motion of Mr. Oast and seconded by Mr. Barnes, the fOllowing resolution was adopted,
<br />and by the following vote:

<br />"A RESOLUTION ACCEPTING THE OFFER TO EXCPiAJ~GE PROPERTY FOR CERTAIN CITY-OWNED PROPERTY
<br />AT THE INTERSECTION OF PRINCETON ROAD AND PINE YALLEY ROAD IN THE CITY OF SUFFOLK,
<br />VIRGINIA; AUTHORIZING THE CITY ~NAGER TO COA~EY SAID PROPERTY TO THE SUCCESSFUL BIDDER.~

<br /> ~EREAS, by resolution adopted by the Council of the City of Portsmouth on May S1,
<br />1977,. the City Manager advertised and received bids for the sale or exchange of certain
<br />City-owned property in the City of Suffolk, Virginia; and
<br />
<br /> WHEREAS, Mr. and Mrs. M. R. Welch, have proposed that the hereinafter-described City-
<br />owned property be exchanged for property owned by Mr. and Mrs. Welch adjacent to the City
<br />of Portsmouth pump station on Princeton Road in Suffolk, Virginia; and
<br />
<br /> WHEREAS, the proposed exchange of property would provide the City with additional
<br />property which could be used in connection with the activities of the Public Utilities
<br />Department currently located on Princeton Road in Suffolk, Virginia.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Manager be, and he hereby is, authorized to accept the proposal for the exchange
<br />of certain hereinafter-described City-owned property for property owned by Mr. and Mrs.
<br />M. R. Welch. The property to be exchanged is described as follows:

<br /> All that cergRint:~tece or parcel of land situate, lying and being in the
<br />City of Suffolk, Virginia, bounded and described as follows:
<br />
<br /> 5. Beginning at a point on the west side of Princeton Road, said point being
<br /> the point at which the line dividing the property owned by the City of Portsmouth
<br /> and the property now' or formerly owned hy M. R. Welch~ intersects the west boundary
<br /> of Princeton Road; then'ce N72~27'05" west, 27.32 feet to the True Point of Beginn-
<br /> ing; thence from said true point of beginning S36°48'41" west 21.18 feet to a point;
<br /> thence N72~17'O5'~ west 52.68 feet to a point; thence N17~49'20" east 20.0 feet to
<br />~<~3:.2a.tpoint;}thence S72°27'O5" east 59.57 feet to the true point of beginning. Said
<br /> parcel containing 1,116.71 square feet as shown on that certain plat entitled, "Plat
<br /> Showing 20' Utility Easement Acquired In Suffolk, Virginia, From M. R. Welch By The
<br /> City Of Portsmouth'~, dated April 18, 1977, prepared by the Department of Engineering,
<br /> City of Portsmouth, Virginia, attached hereto.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to complete
<br />all transactions, execute all documents incident to such conveyance.~'
