245 <br /> <br />July 26, 1977 <br /> <br /> 77-278- "Consideration of an ordinance on first reading to appropriate $20,000 from the <br />Capital Improvements Fund for the demolition, clean-up, and site restoration for the 1912 Muni. <br />pal Building located on Court Street. <br /> <br /> The City has advertised and received bids for the demolition and removal of the 1912 <br />Municipal Building at a cost of approximately $20,000. The contract will include the demoli- <br />tion, clearance, and site restoration for the area adjacent to the 1846 Court House. The Cit <br />Manager recommends adoption on first reading." <br /> <br /> On motion of Mr. Early and seconded by Mr. Oast, the following ordinance was approved <br />on first reading, and by unanimous vote: <br /> <br />"AN ORDINANCE TO APPROPRIATE $20,000 FROM THE CAPITAl IMPROVEMENT FUND FOR THE <br />DEMOLITION, REMOVAl, CLEAN UP AND SITE RESTORATION FOR THE MUNICIPAL BUILDING <br />ON COURT STREET." <br /> <br /> 77-279 "Consideration of an ordinance to amend the City Code by adding a section per- <br />taining to Special Assessments for Open Space Real Estate. <br /> <br /> This ordinance will create a special assessment for open space real estate for property <br />which is over 5 acres. The cities of Virginia Beach, Chesapeake, and Suffolk have previously <br />adopted ordinances similar for the purpose of encouraging the maintenance of recreational <br />facilities. Such special assessment is authorized by the Constitution and the general laws <br />of Virginia. The City Manager recommend§ adoption." <br /> <br /> On motion of Mr. Wentz and seconded by Mr. Early, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />TO CHAPTER 35, ARTICLE IV, THEREOF, SECTION 35-64.1 THROUGH 35-64.7, <br />TO SPECIAL ASSESSMENTS FOR OPEN SPACE REAL ESTATE." <br /> <br />BY ADDING <br />PERTAINING <br /> <br />Ayes: Barly, Elliott, Oast, Went~, Davis <br />Nays: Barnes, Holley <br /> <br /> 77-280 "Consideration of a resolution <br />Development Program and authorizing the City <br />with the submittal of said application. <br /> <br />approving the application for the 1978 Community <br />Manager to do whatever is necessary in connection <br /> <br /> This application has been prepared in accordance with the objectives outlined in the <br />Housing and Community Development Act of 1974; and, upon local approval the application will <br />be forwarded to the State and Regional A-95 Clearing House for comments, which will be sub- <br />mitted along with the application to the Department of Housing and Urban Development. The <br />timetable will coincide with the Federal requirement that such application be submitted at <br />least 75 days before the end of the program year. The City's current program year will expire <br />on November 28, 1977; and, based on the current timetable would permit the fourth action year <br />to be approved and commence on November 29, 1977. The City Manager recommends adoption." <br /> <br /> John Wallace, 118 Riverview Avenue, representing Park View Project Area Committee, <br />requested that consideration be given to the ~roject area be expanded to include the core area <br /> · ei <br />and use the Community Development funds to/~rl~g the area up to standard to what it has been <br />set for the project area. <br /> <br />Executive Director, PRI-Li, responded to Mr. Wallace. <br /> <br /> On motion of Mr. Early and seconded by Mr. Barnes, the following resolution was adopted, <br />and by the following vote: <br /> <br />"A RESOLUTION APPROVING THE 1978 CO~UNITY DEVELOPMENT PROGR~ AND AUTHORIZING <br />THE CITY ~NAGER TO FILE AN APPLICATION THEREFOR. <br /> <br /> WHEREAS, under the provisions of the <br />1974, financial assistance is provided to <br />development activities; and <br /> <br />Housing and Community Development Act of <br />localities for undertaking and carrying out communi~ <br /> <br /> WHEREAS, public hearings have been held and this Council has reviewed a 1978 Community <br />Development Program in the City of Portsmouth; and <br /> <br /> WHEREAS, it is necessary that this Council take appropriate official action respecting <br />said Program to comply with the regulations of the aforementioned Act; and <br /> <br /> WHEREAS, this Council is cognizant of.the conditions that are imposed in the undertaking <br />and carrying out of activities under the Community Development Program; and <br /> <br /> WHEREAS, this Council, on behalf of the City of Portsmouth possesses the legal authority <br />to apply for a grant and execute the proposed Program under the provisions of the aforementio~ <br />Act; and <br /> <br /> WHEREAS, this Council recognizes its responsibility to direct that safeguards be establis <br />to prohibit employees from using their positions for a purpose that is or gives the appear- <br />ance of being motivated by a desire for private gain for themselves or others, particularly <br />those with whom they have family, business or other ties. <br /> <br />d <br /> <br /> <br />
