<br />from the Seaboard Soast Line Railroad, which will be used in connection withZthe improve-
<br />ments on the south end of the waterfront development project. The City Manager recommends
<br />adoption."

<br /> Motion of Mr. Wentz and seconded by Mr. Elliott, that the City Manager be granted
<br />authorization, and was adopted by unanimous vote.

<br />present status of the City's top drainage and street improvement projects, I am forwarding
<br />a status summary of these projects for your information. You will note that substantial
<br />progress has been made and that future progress is largely dependent upon the City's ability
<br />to adequately fund the scheduled projects in future Capital Improvement Programs.

<br />77-310 - The following letter presented from the Slerk of the School Board:

<br /> "At the regular meeting on July 14, 1977, the School Board of the City of Portsmouth
<br />adopted the following resolution and directed that it be forwarded to City Council.
<br />
<br /> 'BE IT RESOLVED that the School Board of the City of Portsmouth request the City~
<br /> Council for authorization to apply for a literary loan in the amount of $750,000
<br /> to help defray the cost of construction of James Hurst Elementary School.'"
<br />
<br /> Million of Mr. Barn~s and seconded by Mr. Early, that authorization be granted, and was
<br />adopted by unanimous vote.

<br /> 77-$12 - On motion of Mr. Barnes and seconded by Mr. Oast, the following resolution was
<br />adopted, and by the following vote:

<br /> "A RESOLUTION DIRECTING THE CITY MANAGER TO APPLY FOR A PERMIT FROM THE VIRGINIA
<br /> DEPARTMENT OF HIGHWAYS AND TRANSPORTATION TO PERFORM EMERGENCY REPAIR OF APPROXI-
<br /> MATELY 800 FEET OF SANITARY SEWER LINE BETWEEN DES MOINES AVENUE AND NORFOLK AND
<br /> PORTSMOUTH BELTLINE RAILROAD IN THE RIGHT-OF-WAY OF INTERSTATE ROUTE 264, AND TO
<br /> SIGN A BOND IN THE, AMOUNT OF $1,OO0.OO FOR SAID PROJECT.
<br />
<br />WHEREAS, it becomes necessary from time to time for the City of Portsmouth to obtain
<br />permits from the Virginia Department of Highways and Transportation to instatl, construct,
<br />reconstruct, maintain and operate certain public works along, across, over and upon the
<br />highway system of Virginia; and
<br />
<br /> WHEREAS, expense, damage or injury may be sustained by the Commonwealth of Virginia
<br /> growing out of th~ granting to said City of Portsmouth by the Virginia Department of Highways
<br /> and Transportation of said permits for the work aforesaid; and
<br /> WHEREAS, one of the conditions of such permit or permits is that the City of Portsmouth
<br /> shall indemnify the Commonwealth of Virginia against all damages and injuries to the highways
<br /> and bridges and to property lawfully upon such highways.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br /> that the City Manager be, and he hereby is, directed to apply for a permit from the Virginia
<br /> Department of Highways and Transportation to perform emergency repair of approximately 800
<br /> feet of sanitary sewer line, and to sign a bond in the form attached hereto in the amount
<br /> of One Thousand~and OO/1OO ($1,OOO.OO) Dollars, for the hereinabove mentioned project.

<br /> This resolution shall be effective from the date of its adoption."
