<br />AMENDING SECTION 40-31
<br />THE ELDERLY."
<br />
<br />THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY
<br />THEREOF, PERTAINING TO THE DEFINITION OF HOUSING FOR
<br />
<br />The City Attorney presented the following report:
<br />
<br /> "fit the August 8, 1977 Public Hearing, you requested me to report to you the criteria
<br />which is set forth in 12 U.S.C. 1701, which section was recommended by the Planning Commission
<br />to be incorporated by reference as the definition of housing for the elderly.
<br />
<br /> 12 U.S.C. 1701 in my opinion, is inappropriate for a definition of housing for the elderl
<br />in this instance. Said section requires that before a person or family is qualified for
<br />housing for the elderly, they must have an income which qualifies them for public housing.
<br />I do not believe that either the Planning Commission or the City Council had intended such
<br />a criteria.
<br />
<br /> Accordingly, it is my recommendation that housing for the elderly be defined as housing
<br />for:
<br />
<br />(1) A person 62 years old or above;
<br />
<br />(2) A family in which the head of same, or spouse, is 62 years or above;
<br />
<br />(3) A handicapped person;
<br />
<br /> (4) A family in which the head of same, or spouse, is handicapped.
<br />
<br /> Because the definition of housing for the elderly was advertised as incorporating by
<br />reference 12 U.S.C. 1701, it is my recommendation that this matter be referred back to the
<br />Planning Commission for their further consideration and recommendation."
<br />
<br /> On motion of Mr. Wentz and seconded by Mr. Barnes, the ordinance was adopted, and by
<br />the following vote:

<br /> Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis
<br /> Nays: None
<br />
<br /> Motion of Mr. Barnes and seconded by Mr. Elliott, the ordinance to referred to the
<br />Planning Commission for amendment, and was adopted by unanimous vote.

<br /> AMENDING SECTION,S 40-93 and 40-102(a) AND 40-102(j) THEREOF, PERTAINING TO
<br /> HISTORIC DISTRICT."
