Said section requires that before a person or family is qualified for
housing for the elderly, they must have an income which qualifies them for public housing.
I do not believe that either the Planning Commission or the City Council had intended such
a criteria.

Accordingly, it is my recommendation that housing for the elderly be defined as housing
for:

(1) A person 62 years old or above;

(2) A family in which the head of same, or spouse, is 62 years or above;

(3) A handicapped person;

(4) A family in which the head of same, or spouse, is handicapped.

Because the definition of housing for the elderly was advertised as incorporating by
reference 12 U.S.C. 1701, it is my recommendation that this matter be referred back to the
Planning Commission for their further consideration and recommendation."

On motion of Mr. Wentz and seconded by Mr. Barnes, the ordinance was adopted, and by
the following vote:

Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis
Nays: None

Motion of Mr. Barnes and seconded by Mr. Elliott, the ordinance to referred to the
Planning Commission for amendment, and was adopted by unanimous vote.

77-296 - The following ordinance approved on first reading at the~}Public Hearing meeting
of August 8, 1977, was taken up and read:

(g) "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY
AMENDING SECTION,S 40-93 and 40-102(a) AND 40-102(j) THEREOF, PERTAINING TO
HISTORIC DISTRICT."

On motion of Mr.
the following vote:

Ayes:
Nays:

Wentz, and Seconded by Mr. Early, the brdinance was

Barnes, Early, Elliott, Holley, Oast, Wentz, Davis
None

adopted, and by

77-299 - The following ordinance approved on first reading at the regular m~eting of
August 9, 1977, was taken up and read:

"AN ORDINANCE TO APPROPRIATE $60,000 FROM THE CAPITAL IMPROVEMENT FUND FOR
EXPENSE~ INCURRED DEVELOPING A SURVEY CONTROL."

On motion of Mr. Wentz and seconded by Mr. Early, the ordinance was adopted,
following vote:

Ayes: Barnes, Early, Elliott, Holley, Oast, Wentz, Davis
Nays: None

and by

the
