However, under State law an ordinance is re- <br />quired granting the authcrization for the refund of any taxes. This orainanee will provide <br />the authorization to refund all utility services taxes previously adjudicated. The City Manag~ <br />recommends adoption." <br /> On motion of Mr. Elliott and seconded by Mr. Early, the following ordinance was adopted <br />on first and final reading, and by the following vote: <br /> "AN ORDINANCE AUTHORIZING THE REFUND OF UTILITY SERVICE TAXES ADJUDICATED TO BE <br /> 'INVALID." <br /> <br /> Ayes: Barnes, Early, Elliott, Oast, Davis <br /> Nays: None <br /> <br /> 78-51 - "A report from the City Manager outling the amount of funds that have to be trans <br />ferred from the Emergency Contingency Account to cover the refunds authorized for the Utility <br />Service %axes is attached for your information. The previous amount reported to the City <br />Council was for $26:015. This report detials the total amount of refunds including the total <br />amount of all funds that have been transferred for this purpose.~ <br />mitred for your information in accordance with the City Code." <br /> <br /> Motion of Mr. Elliott and seconded by <br />adopted by unanimous vote. <br /> <br /> 78-52 ,'Consideration of a resolution supporting <br />the Anti-litter Control Program. <br /> <br /> This report is being sub- <br />Barnes, the report to be accepted, and was <br /> <br /> a grant application for S~ate funds <br /> <br />for <br /> <br /> The Virginia Litter Control Act of 1976 provides through the Department of Consumer and <br />Economic Development, Division of Litter Control, for the allocation of public funds in the <br />form of grants for the purpose of promoting anti-litter statutes and ordinances. The City <br />has prepared an application for grant funds and this resolution supports and endoreses this <br />application being submitted on behalf of the City of Portsmouth. The City Manager recommends <br />adoption." <br /> On motion of Mr. Barnes and seconded by Mr. Elliott, the following resolution was adopted <br />and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO APPLY FOR A GRANT FOR THE PURPOSE <br />OE PROMOTING ENFORCEMENT OF THE ANTI-LITTER CONTROL PROGRAM. <br /> <br /> WHEREAS, the City Council recognizes the existence of a litter problem within the <br />boundaries of the City of Portsmouth; and. <br /> <br /> WHEREAS, the Virginia Litter Control Act of 1976 provides, through the Department <br />of Conservation and Economic Development, Division of Litter Control, for the allocation <br />of public funds in the form of grants for the purpose of promoting enforcement of the <br />anti-litter statutes and ordinances and for the purpose of enhancing local litter control <br />programs; and <br /> <br /> WHEREAS, the City Council have reviewed and considered the regulations and the appllca~ <br />tion covering the Administration and use of said funds. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that it hereby endorses and supports such a program for the City of Portsmouth as indicated <br />in the attached application Form LCG-1. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is authorized to plan, budget and apply <br />for a grant, which if approved, will be used to fund said program. <br /> <br /> BB IT FURTHER RESOLVED that the Department of Conservation and Economic Development, <br />Division of Litter Control, is requested to consider and approve said application program, <br />said program being in accord with the regulations governing use and expenditure of said <br />funds." <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Davis <br />Nays: None <br /> <br /> 78-53 "Consideration of a resolution providing for the execution and delivery of dupli- <br />cate General Obligation Bonds in the ~mouD%-.of $50;000 to replace lost bonds. <br /> <br /> We have been advised by our fiscal agent that $50,000 of General Obligation bonds have <br />been lost on their premises. These bonds were being forwarded to the fiscal agent, with <br />coupons, for registration. In order to issue duplicate bonds, the State Statute requires <br />approval by the State Commission on local debt; and this resolution will serve as a request <br />for that approval. The City will be indemnified for any loss over the original $50,0000. <br />The City Manager recommends adoption." <br /> <br /> <br />
