<br /> On motion of Mr. Barnes and seconded by Mr. Holley, the following ordinance was approved
<br />on first reading, and by unanimous vote:
<br />
<br />"AN ORDINANCE TO APPROPRIATE $200,000 FROM THE CAPITAL IMPROVEMENT FUND FOR
<br />CAPITAL IMPROVMENTS TO SELECTED SCHOOL FACILITIES."
<br />
<br /> 78-121 "Consideration of an ordinance on first reading to appropriate $66,000 from the
<br />General Fund for data processing equipment rental.
<br />
<br /> This appropriation will provide the necessary funds for the Contractual Division of the
<br />Data Processing Department to provide additional computer equipment to the Adult Offender
<br />Grant, the Human Services Grant, and the Office of the Commissioner of Revenue. Expenditures
<br />by the Contractual Division of the Data Processing Department are full reimbursed by the
<br />agencies which it serves. Therefore, additional revenues to the General Fund will completely
<br />offset these additional expenditures. The City Manager recommends adoption on first reading."

<br /> 78-122 "Consideration of an ordinance to amend the City Code pertaining to penalties
<br />for violations of the operation of taxi cabs.
<br />
<br /> The Commonwealth Attorney has requested a stricter ordinance pertaining to penalties
<br />for violations of the operation of taxi cabs. He has experienced numerous complaints from
<br />persons authorized to operate taxi cabs, of violations of the City's ordinance pertaining
<br />to taxi cabs. This ordinance will provide for stricter penalties for thsse persons convicted
<br />of violations. The City Manager recommends adoption.'

<br /> Motion of Mr. Oast and seconded by Mr. Elliott, the matter to be deferred to the next
<br />meeting (April 25, 1978), and was adopted by unanimous vote.
<br />
<br /> 78-123 "Consideration of a resolution to provide for eminent domain proceedings neces-
<br />sary for construction expansion of port facilities in Pinners Point.
<br />
<br /> This resolution will authorize the~City Attorney to file eminent domain proceedings again
<br />a parcel of property located in the port facilities area in Pinners Point. This authorization
<br />is necessary because there are 11 persons on the title of this property, some of whom cannot
<br />be located. The City Manager recommends adoptioh."

<br /> On motion of Mr. Oast and seconded by Mr. Elliott, the following resolution was adopted,
<br />and by the following vote:

<br />PORTSMOUTH, VIRGINIA, UNDER EMINENT DO~IN PROCEEDINGS PURSUANT TO C~PTER 471
<br />OF THE ACTS OF ASSEMBLY, 1970, AS AMENDED, SAID PROPERTY BEING NECESSARY FOR
<br />CONSTRUCTION AND EXPANSION OF THE PORT FACILITIES IN PINNERS POINT.
<br />
<br /> WHEREAS, the City of Portsmouth has found it necessary to acquire the interest hereinafte'
<br />specified in and to the hereinafter described parcel of land situate in the City of Portsmouth
<br />foz..the purpas~ of constructing and expanding the port facilities in Pinners Point; and
<br />
<br /> WHEREAS, the
<br />herein, necessary
<br />cannot be located,
<br />
<br />City of Portsmouth has not been able to purchase the property described
<br />to the project, because all of the present record owners of said property
<br /> thus, creating a defect in the record title of said property; and
<br />
<br /> WHEREAS, the advancement of the work and use of said project will be delayed unreasonably
<br />if said property is not made available as soon as possible.
<br />
<br /> NOW, THEREFORE, B~ IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Attorney be, and he hereby is, directed to institute eminent domain proceedings
<br />against the following described property situate in the City of Portsmouth, Virginia, for
<br />the purpose of acquiring fee simple title therein, together with any and all easements of
<br />access, light or air incident to the lands of the landowner abutting upon said property in
<br />accordance with and pursuant to Sections 2.06, 2.0? and 2.08 of the Charter of the City of
<br />Portsmouth (Chapter 471 of the Acts of Assembly, 1970, as amended) and to deposit to the
<br />credi~ of the Clerk of the Circuit Court of the City of Portsmouth, Virginia, as provided
<br />by law, the sum hereinafter specified to compensate the owners of the parcel of land.
<br />
<br /> The name of the property owners are: William W. Dew, Miriam Bstelle Dew Smith, Richard
<br />R. Dew, Bertha F. Shawn, Ida Mae King, Elsie L. Dew, Joseph E. Dew, Jr., Thomas L. Dew, Rosser
<br />M. Dew, Jr. and Lawrence V. Dew.
<br />
<br /> The amount to be deposited with the Clerk of the Circuit Court of the City of Portsmouth
<br />is: $2,$OO.OO.
