78-253 - "Consideration of an ordinance to amend the CitY Code pertaining to sewer connection fees. The present City Code section provides for a sewer connection fee whenever a building has been removed from a site and a new building replaces same. For example; this charge would be applicable when an apartment house is replaced by a single family dwelling. This ordinance will provide that a sewer connection charge will have to be paid only if the replace- ment building requires increased service. The City Manager recommends adoption." On motion of Mr. Holley and seconded by Mr. Gray, the following o~dinance was adopted on first and final reading, and by the following vote: "AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, BY ~4ENDING SUBSECTION 118.12 OF SECTION 6-8 THEREOF, PERTAINING TO CHARGES FOR SEWER CONNECTION." WHEREAS, the City of Portsmouth presently owns certain'Parcels of property located adjacent to the Churchland Academy Elementary School, which parcels were conveye~ to ~the City of Portsmouth pursuant to the terms of the 1968 annexation of property of the City of Chesapeake, Virginia (Norfolk County); and ~FHEREAS, said land is no longer needed by the City of Portsmouth or the Portsmouth School Board and it is, therefore, declared to be surplus property. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to advertise and receive bids for the hereinafter described property on such terms and subject to such minimum bid restrictions as he may deem propers. The property to be advertised is more particularly described as follows: All those certain~lots, pieces or parcels of land, situate, lying and being in the City of Portsmouth, Virginia, known, n~mbered and designated as lots 25, 26 and 27, Block 21 on the plat of Churchland Land Company, recorded in the Clerk's Office of the Circuit Court of the City of Chesapeake, Virginia." Notice has been given to the affected land owners that a public hearing would be held by Council this date. The abutting land owners shall be assessed at the rate of $5 per frontal lineal foot.
