<br /> unmarried, and John Robert Shaw, et ux, each deed bearing date of July 15,
<br /> 1954, recorded in the aforesaid Clerk's Office in Deed Book 272, page 272

<br /> WHEREAS, said land is no longer needed by the City of Portsmouth and it is, therefore,
<br />declared to be surplus property.
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />the City Manager be, and he hereby is, authorized to advertise and receive bids for the here-
<br />inabove described property on such terms and such minimum bid restrictions as he may deem prop

<br /> 78-297 - "Consideration of:a:resotntion authorizing the City Manager to exchange property
<br />with the Va. Department of Highways and Transportation for development of a sludge disposal
<br />site for the Public Utilities Department.
<br /> This ~amolution finalizes the original commitment previously authorized by.the City Counc
<br />for exchange of the property in order to develop a sludge disposal site. This is an even ex-
<br />change of land. No cash outlay by either party. The City Manager recommends adoption." (2~
<br /> On motion of Mr. Barnes and seconded by Mr. Early, the following resolution was adopted,
<br /> and by the following vote:

<br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXCHANGE PROPERTY WITH THE.VIRGINIA
<br /> DEPARTldENT OF HIGHWAYS AND TRANSPORTATION FOR DEVELOPMENT OF A SLUDGE DISPOSAL
<br /> SITE FOR THE PUBLIC UTILITIES DEPARTMENT.
<br /> WHEREAS, the Portsmouth Public Utilities Department is advised to obtain property located
<br /> in the City of Suffolk owned by the Virginia Department of Highways and Transportation for
<br /> the purpose of constructing a disposal site for sludge and waste discharge from the water
<br /> filtration plant; and
<br /> WHEREAS, the virginia Department of Highways and Transportation desires to obtain propert
<br /> Owned~ by the City of suffolk in the Lake Kilby watershed for the purpose of constructing
<br /> the southwest bypass; and
<br /> WHEREAS, the Charter of the City of Portsmouth, Section 2.O9(c) provides that the City
<br /> may convey property to the Commonwealth of Virginia or any political subdivision thereof
<br /> without advertisement and without receiving bids.
<br /> NOW, THEREEOgE,:~B~ :IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br /> that the City Manager be, and he hereby is, authorized to exchange the hereinafter degc. ribed
<br /> property'with the Virginia Department of Highways and Transportation, subject to the condition
<br /> and restrictions stated herein, for the purpose of development of a sludge disposal site
