<br /> Virginia), bounded and described as follows:

<br /> On the north by a branch of BeaVer Dam Run forming the boundary line between
<br />the land hereby conveyed and the tract of land above-described (Parcel II) known
<br />as the "Benton Land", the land of Otis S. Smith, Sr., and the land of the City
<br />of Portsmouth; on the South by the right of way of the Jackson Lumber Company
<br />(formerly Suffolk Lumber Company); on the east by the land formerly of Alcora
<br />Folk (Faulk)and now of Butts' Estate and on the west by the line of the property
<br />of the City of Portsmouth (at Beaver Dam run) and contains 52.5 acres.

<br />The conditions of this conveyance shall be as follows:

<br /> (1) That tk~ C-~of Portsmouth shall retain the option to purchase such portions of
<br />the herein-described property which are not included in the right of way of the southwest
<br />bypass after construction of said highway. The price to be paid for repurchase shall be One
<br />Dollar ($1.00) per parcel.

<br /> (2) That the City of Portsmouth reserve to itself the timber rights on the herein-describ
<br />property exclusive of that portion Of the standing timber which will be included in the right
<br />of waM~:of the southwest bypass.

<br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized to execute
<br />such deeds and other documents as may be necessary to complete this transaction."

<br />has made application to close a portion of Fayette and Madison Streets.

<br /> This resolution is in compliance with State Law ta~-:mppoint viewers. This application
<br />has been ~ppmo~ed~by; ~he:Planming~Ce~mission. The City Managerrecommends adoption."

<br /> On motion of Mr. Early and seconded by Mr. Oast, the following resolution was adopted,

<br />"A RESOLUTION APPOINTING VIEWERS FOR CLOSING THE FOLLOWING STREET: A PORTION
<br />OF EIGHTH STREET BETWEEN FAyETTE STREET AND MADISON STREET.

<br /> WHEREAS, Portsmouth Redevelopment And Housing Authority has made application to vacate,
<br />close and discontinue the hereinafter-described portion of a certain street, and it appearing
<br />that NoZice of Application and request for the appointment of viewers was duly posted August
<br />7, 1978, on the bulletin board of the General District Court, Civil Division, of the City
<br />of Portsmouth, and the bulletin board of the City Hall of the City of Portsmouth.

<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that
<br />Frank N. Bilisoly, L. A. Clark, James J. Linehan, Raymond Tweed, Linon Vann be aPPointed viewers
<br />and Robert Reed be appointed an alternate viewer in the event one of the preceding viewers
<br />fail to participate, said viewers to view the her. einafter described port~on of such street
<br />and to report to this Council in writing whether in their opinion anY, and if any, what inconven-
<br />ience would result in vacating and closing the following:
