ORDINANCE NO. 2026-09 <br />AN ORDINANCE ACCEPTING SETTLEMENT FUNDS IN THE AMOUNT OF <br />$269,765.39 FROM OPIOID SETTLEMENTS AND APPROPRIATING SAID <br />AMOUNT IN THE FY 2026 BEHAVIORAL HEALTHCARE SERVICE FUND <br />FOR USE BY BHS FOR APPROVED ABATEMENT PURPOSES AS DEFINED <br />BY THE VIRGINIA OPIOID FUND AND SETTLEMENT ALLOCATION MOU. <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That it hereby accepts settlement funds in the amount of $269,765.39 from <br />opioid settlements and appropriates said amount in the FY 2026 Behavioral Healthcare <br />Service Fund. <br />2. That the appropriation shall be used by the Department of Behavioral <br />Healthcare Services for "Approved Abatement Purposes", as defined in Section A and <br />illustrated in Section (C)(4)(a) through 0) of the Virginia Opioid Abatement Fund and <br />Settlement Allocation Memorandum of Understanding approved by City Council <br />Resolution R-21-24 adopted on August 10, 2021, as amended from time to time. <br />"Approved Abatement Purposes" are generally defined in the MOU as "efforts to treat, <br />prevent, or reduce opioid use disorder or the misuse of opioids or to otherwise abate or <br />remediate the opioid epidemic". <br />3. That, to the extent not expended, the funds shall be deemed reappropriated <br />into the Behavioral Healthcare Service Fund budget annually until expended in their <br />entirety. <br />4. That no local match is required as a condition of the funding. <br />5. That estimated revenues and expenditures in the FY 2026 Behavioral <br />Healthcare Service Fund Budget are increased by $269,765.39. <br />6. That this ordinance shall take effect on the date of its adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on January 13, 2026. <br />Teste: <br />City Clerk <br />
