neatly at curbside in a pile not to exceed six feet by six feet by six feet in height. Tree <br />parts greater than 18 inches in diameter will not be picked up by the city and will be <br />the responsibility of the home owner or tenant for disposal. It shall be the <br />responsibility of the owner or tenant of the premises involved to remove all tree <br />trimmings, cuttings, shrubbery and the like that do not meet these specifications or <br />those contained in sections 16-32(b) or 16-34(c). Tree and shrubbery branches, limbs <br />and trimmings cut by landscape or tree service contractors will not be collected by the <br />city. Owners or tenants placing items for collection cut by tree and landscape <br />contractors will be subject to the charges and penalties of section 16-31 of this <br />division. <br />(d) Bulk refuse shall not be collected by the city from vacant lots, business and <br />commercial establishments, including multifamily residential complexes. <br />(e) Bulk waste placed for collection without a scheduled appointment in accordance with <br />section 16-35(b) must be removed within 24 hours of notice provided by the director <br />or his designee. Notice may be provided in writing or by posting on the property. <br />(f) Violations of this section that are not timely corrected shall be punishable by a fine of <br />not less than $500.00 or more than $1,000.00 per occurrence, in addition to costs <br />assessable under section 16-31. <br />Sec. 16-36. Frequency, times and dates containers to be placed for collection. <br />(a) Garbage and household trash accumulated at residences shall be collected by the city <br />one (1) time each week, except when otherwise designated by the city manager or his <br />designee. <br />(b) Normally, in the areas receiving automated refuse and recycling collection, residents <br />may place the container for collection at any time after 5:00 p.m. the day before and <br />by 7:00 a.m. on days of collection or as specified by the director. Such receptacles <br />should be removed from the collection site as soon as possible after collection and <br />stored beside or behind the dwelling or at a site acceptable to the director. Receptacles <br />must be removed by the evening of collection day. Yard waste packaged in clear <br />plastic bags shall be placed out for collection at the same time as the automated refuse <br />container. <br />Sec. 16-37. Positioning of materials for collection. <br />(a) All garbage, trash, paper, corrugated cartons, paper or pasteboard boxes, and other <br />waste, to be removed by the city under this article shall be placed on the sidewalk as <br />near to the curb as possible or between the sidewalk and the curb, except where <br />otherwise authorized by the city manager. Bulk refuse shall always be placed as near <br />to the curb as possible or between the sidewalk and the curb and shall not be placed in <br />public alleys even where same are provided. Bulk refuse must be placed clear of water <br />meters, TV cable boxes, power lines, utility poles and tree limbs. <br />(b) No materials, containers, or bulk refuse shall be placed for collection more than 24 <br />hours prior to the scheduled collection date. Any materials, containers. or bulk <br />materials placed in violation of this subsection (b) must be removed within 24 hours <br />of notice provided by the director or his designee.
