(f) If centralized refuse containers are used in residential developments, they shall be <br />located in an area or areas conveniently accessible to all residents. The containers shall <br />be enclosed on three sides by a solid wood or masonry wall with a solid opaque gate <br />provided on the fourth side. Landscaping shall be incorporated to improve the visual <br />appearance. Support posts, gate frames, hinges and latches should be of sufficient size <br />and strength to allow gates to function without sagging or becoming an eyesore. <br />(g) If individual refuse containers are used for the units in a residential development, the <br />site plan shall provide adequate storage space and outdoor access to such storage for <br />the occupant or each residential structure to store the refuse container in a side or rear <br />yard. <br />ARTICLE II. CITY COLLECTIONS <br />DIVISION 1. GENERALLY <br />Sec. 16-31. Abatement of violations of chapter. <br />If an owner or occupant fails, refuses or neglects to comply with any provision of this <br />chapter after delivery or posting of reasonable notice of violation of this division, the <br />director may invoke the provisions of sections 16-2, 16-5, 16-33, 16-35, or 16-37 and/or <br />cause the nuisance or the condition which is in violation of this division to be abated and <br />may transmit to the city treasurer a statement of all costs incurred thereby. Included in such <br />costs shall be a $150.00 fee to cover the administrative expense incurred and a fee of <br />$250.00 per load or portion thereof for the use of the city's waste management vehicles and <br />equipment. All such costs shall be added to the taxes assessed against the real estate on <br />which the nuisance or condition in violation of this division existed or the real estate <br />abutting the alley, sidewalk or street on which the nuisance or condition in violation of this <br />division existed, for the ensuing tax year and shall be collected with such taxes by any <br />manner prescribed by law for the collection of city taxes. All costs incurred thereby shall <br />be docketed as a lien against such real property, in the nuisance abatement lien docket book <br />maintained in the office of the city treasurer, which lien shall exist in the office of the city <br />treasurer until removed by payment of such costs in full. <br />Sec. 16-33. Substances permitted in containers. <br />(a) No substance other than garbage, trash or recyclables shall be placed in the approved <br />containers required by section 16-32. The placement of hazardous waste in the <br />approved containers is strictly prohibited. <br />(b) Violations of this section must be corrected within 24 hours of notice provided by the <br />director or his designee. Notice may be provided in writing or by posting on the <br />property. <br />
