EXHIBIT A Chapter 16 and Appendix A of the Code of the City of Portsmouth, Virginia are amended as shown below. Except as expressly shown below, Chapter 16 and Appendix A of the Code of the City of Portsmouth, Virginia are not otherwise amended. 1. Chapter 16 is amended as shown below. ARTICLE I. IN GENERAL Sec. 16-1. Definitions. The following words, terms and phrases, when used in articles I and II of this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: Approved container means a storage and collection receptacle or container required for the storage and collection of solid waste or recyclables issued by the city and used in the automated solid waste collection program. Automated refuse collection means collection service provided to residences equipped with a city -furnished 95 -gallon automated collection container. Bulk refuse means the term "bulk refuse" shall include bulky items such as household construction debris not generated by a contractor, furniture, tree trimmings, cuttings, shrubbery and the like. Business or commercial establishments means any premises wherein: (1) There is carried on any business, profession or occupation subject to the license tax ordinance of the city; or (2) There is carried on any broadcasting, publishing, manufacturing or commercial activity or process, including the renting of residential property; or (3) There are multifamily units of four or more including condominium units. Construction site means any area in which construction of any type is conducted, including roads, buildings and all other places actively being constructed or renovated by public or private owners or the agent, employees or contractors thereof. Director shall mean the director of public works of the city or the director's authorized representative. Dwelling means any building which is wholly or partly used or intended to be used for living or sleeping by human occupants. Dwelling unit means any room or group of rooms located within a dwelling and forming a single habitable unit with facilities which are used or intended to be used for living, sleeping, cooking and eating.
