Garbage means putrescible animal and vegetable wastes resulting from the handling, <br />preparation, cooking and consumption of food. <br />Hazardous wastes means those wastes that can cause serious injury or disease during <br />the normal storage, collection of disposal process, including, but not limited to, flammable, <br />explosive, pathological or infectious wastes, radioactive materials and dangerous <br />chemicals. <br />Industrial waste shall include building material waste resulting from erecting, <br />removing, repairing, remodeling or razing buildings; used parts from vehicles and tires of <br />a size 800 by 20 and greater; ashes from boilers, incinerators, or other trash or matter <br />originating in a business or manufacturing establishment intended not for use or sale. <br />Operator means the person operating any business or commercial establishment as <br />distinguished from the owner of the premises involved. <br />Recyclables means items, including but not limited to, newspapers, cardboard, junk <br />mail, and catalogs, papers; clear glass bottles and jars; plastic containers #1 and #2; <br />aluminum cans, aluminum foil and steel/tin food cans. <br />Refuse means any putrescible and nonputrescible solid wastes (except body waste), <br />including garbage, rubbish, trash, ashes and other similar wastes. <br />Small dead animals means dead cats, dogs, small household pets and other animals of <br />similar size. <br />Tires shall mean a privately owned vehicle tire of a size less than 800 by 20. <br />Trash means the accumulation of waste paper, rags, bottles, cans or other similar <br />matter. <br />White goods shall mean large household appliances such as refrigerators, water <br />heaters and washing machines. <br />Yard waste means material derived from leaves, shrubbery trimmings, and lawn <br />trimmings. <br />Sec. 16-2. Violations of chapter. <br />(a) Unless otherwise specifically provided, a violation of any provision of this chapter <br />shall constitute a class 3 misdemeanor. Additionally, any person in violation of any <br />provision of this chapter shall be liable for all damage, loss and expense suffered or <br />incurred by the city as a result of such violations. <br />(b) When a violation of the refuse provisions of this chapter has occurred the person listed <br />as responsible for payment of the refuse bill for that address shall be presumed to be <br />the person causing the violation. Such presumption shall be rebuttable by competent <br />evidence as determined by the director or his designee. <br />(c) In accordance with § 15.2-901 of the Code of Virginia, the first violation under this <br />chapter, excluding the provisions of sections 16-5, 16-33, 16-35, and 16-37, shall <br />result in a violation notice being sent to the owner or occupant of the property or the <br />posting of notice on the property.
