(8) Neon Lighting The use of neon lighting as an access is discouraged in the LINC Overlay District. If used, neon lighting is subject to the following: (a) Neon lighting is only permitted for projecting, window, and wall signs. (b) Neon lighting shall be used as an accent material on projecting and wall signs, such as for letters, logos, and/or sign details. No projecting, window, or wall sign may be entirely illuminated with neon. (c) Neon lighting on projecting and wall signs shall not be illuminated during daylight hours. When lit, neon lighting must be continuously illuminated. Flashing neon is prohibited. (d) Neon lighting on projecting and wall signs shall not be combined with any reflective materials (e.g. mirrors, polished metal, highly glazed tiles, or other similar materials) that would cause glare and increase the spread of light. 3. Section 40.2-213 (Commercial uses) is amended by adding "Commissary Kitchen" as follows: Sec. 40.2-213. Commercial uses. Eating and Drinking Establishments BREWERY/DISTILLERY—The use of land, licensed by the Commonwealth of Virginia, where beer or spirts are manufactured for sale. Breweries have a capacity less than 15,000 barrels a year and distilleries have a capacity less than 36,000 gallons a year. Permitted accessory uses include retail sales, tasting rooms for beverages produced on-site, restaurants, reception halls, and live entertainment (Code of Virginia § 15.2-2288.3:1, 3:2). COMMISSARY KITCHEN – A commercial shared use kitchen used on a contract basis by food service providers to prepare, fabricate, package, and store food, food products and equipment, and that is inspected and permitted by applicable health agencies. MICRO-BREWERY/DISTILLERY—An establishment primarily engaged in brewing ale, beer, wine, cider, malt liquors, and nonalcoholic beer, with a capacity of not more than 1,000 barrels per year OR distilling and blending potable liquors, including mixing them with other ingredients, with a capacity of not more than 5,000 gallons of finished product per year. A micro-brewery/distillery may include a restaurant or public tasting room as an accessory use (Code of Virginia § 15.2-2288.3:1, 3:2). 4.
