Good faith bargaining. <br />(1) An exclusive bargaining representative must submit a written request to the <br />City Manager for any collective bargaining intended to result in a collective <br />bargaining agreement to become effective for a given fiscal year in time for <br />collective bargaining to begin on or before July 1 of the preceding fiscal year <br />and conclude, including any impasse resolution procedures, by December 1 <br />of the preceding fiscal year to ensure adequate time for inclusion in the City <br />Manager's proposed budget for the target fiscal year. Within ten business <br />days from the receipt of a request for bargaining, the parties' designated <br />representative(s) shall mutually agree upon and schedule dates and times to <br />meet for collective bargaining. <br />(2) Collective bargaining shall be conducted in accordance with ground rules <br />established by the parties' representatives at the commencement of the process <br />which rules shall, at a minimum, include provisions governing the <br />confidentiality of negotiations. All discussions and negotiations will be <br />conducted in a professional and courteous manner. <br />(3) Nothing in this division requires either party to make any concessions or agree <br />to the other party's proposals. <br />(4) Good faith bargaining shall not include submission of or a response to a <br />proposal that (i) violates the rights of employees as set forth in section B, or <br />(ii) impairs, restricts, or delegates any authority of the City that this division <br />or other applicable law explicitly reserves solely to the City. <br />A-19 <br />
