ORDINANCE NO. 2025-58 <br />AN ORDINANCE TO AMEND AND REORDAIN CHAPTER 40.2 OF THE CODE <br />OF THE CITY OF PORTSMOUTH, VIRGINIA (ZONING ORDINANCE) TO <br />ADD AND MODIFY REQUIREMENTS AND ENFORCEMENT REGULATIONS <br />FOR ENTERTAINMENT ESTABLISHMENTS, EVENT PLACES, AND <br />RESTAURANTS, AND TO ESTABLISH AND REGULATE A NEW USE <br />CATEGORY FOR PRIVATE CLUBS, BY AMENDING SECTION 40.2-212 <br />(PUBLIC AND INSTITUTIONAL USES), SECTION 40.2-217 (USE -SPECIFIC <br />STANDARDS), TABLE 40.2-216 (USE TABLE) AND TABLE 40.2-301(1) <br />(MINIMUM OFF-STREET PARKING STANDARDS), AND ADDING A NEW <br />SECTION 40.2-255 (REVOCATION OF PERMITS). <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br />1. That Chapter 40.2 of the Code of the City of Portsmouth, Virginia <br />(Administration) is amended and reordained through adoption of the modifications set forth <br />on Exhibit A hereto. <br />2. That the purpose of the amendment is to add and modify requirements and <br />enforcement regulations for entertainment establishments, event places, and restaurants, and <br />to establish and regulate a new use category for private clubs. <br />3. That the amendments to 40.2-217(E)(2), (G)(3)(a), (G)(5)(b), and (G)(5)(c) <br />are not intended to apply to entertainment establishments, event space/banquet halls, <br />restaurants, or private clubs that are existing legal nonconforming uses as of the adoption of <br />this ordinance unless and until such use has been discontinued in accordance with 40.2- <br />402(B)(10) or its legal nonconforming status has otherwise terminated in accordance with <br />40.2-402(B) of the Zoning Ordinance. <br />4. That the amendments of 40.2-217(G)(5)(b) and (G)(5)(c) are not intended to <br />apply to entertainment establishments or event space/banquet halls that hold a valid use <br />permit for the respective use that remains in effect as of the adoption of this ordinance <br />unless and until such permit has been revoked or is otherwise no longer legally valid. <br />5. That except as provided in Section 1 above, Chapter 40.2 of the City Code is <br />not otherwise amended. <br />6. That this ordinance shall take effect on the date of adoption. <br />ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held <br />on August 26, 2025. <br />Teste: <br />City Clerk <br />
