Application open for public inspection. <br />All applications fi -le this division, , maps and documents relating thereto <br />filed under this division ; shall be open for public inspection at the office of the <br />d@Patim—, de artment of planning. <br />Sec. 39 -85. Hearing on application. <br />(a) Not later than 60 days after receipt of a complete application under this <br />division, the wetlands board shall hold a public hearing on such application. The <br />applicant, the city council, the commissioner, the owner of record of any land <br />adjacent to the wetlands in question, known claimants of water rights in or <br />adjacent to the wetlands in question, the Virginia Institute of Marine Science, the <br />state Department of Wildlife Resources, <br />the state Water Control Board, the state &paAmwit of <br />Department of Transportation and governmental agencies <br />expressing an interest therein shall be notified by the wetlands board of the <br />hearing by mail not less than 20 days prior to the date set for the hearing. The <br />wetlands board shall also (i) post a notice of the hearing on its website at least 14 <br />days prior to such hearing; (ii) provide a copy of such notice to the commmission <br />for submittal to the Virginia Regulatory Town Hall; and (iii) cause notice of <br />the hearing to be published at least once in the seven days <br />prior to such hearing in a newspaper having a general circulation in the city. The <br />cost of such publication shall be paid by the applicant. <br />(b) The chair of the wetlands board, or in their absence the acting <br />chair may administer oaths and compel the attendance of witnesses. <br />
