Any person may appear and be heard at the public hearing. Each witness at the <br />hearing may submit a concise written statement of his testimony. <br />Sec. 39 -86. Determination of board; grant or denial. <br />(a) The wetlands board shall make its determination on an application filed under this <br />division within 30 days from the hearing provided for in section 39 -85. If the <br />board fails to act within such time, the application shall be deemed approved. For <br />purposes of this section, "act" means taking a vote on the application, Within 48 <br />hours of its determination, the board shall notify the applicant and the <br />commissioner of such determination, and if the board has not made a <br />determination, it shall notify the applicant and the commission that 30 days has <br />passed and that the application is deemed approved. <br />(b) In acting on any application for a permit under this division, the wetlands board <br />shall grant the application upon the concurring affirmative vote of four <br />members. If the application receives less than four affirmative votes, the permit <br />shall be denied. <br />(c) In deciding whether to grant, to grant in modified form or to <br />deny a permit under this division, the wetlands board shall 4-s- kmisiwn en <br />consider the following: <br />(1) <br />The testimony of any person in support of or in <br />opposition to the permit application; <br />(2) <br />The impact of the proposed development on the public health, safety, and <br />welfare-, and <br />33) The proposed development's conformance with standards prescribed in § <br />28.2 -1308 of the Code of Virginia and guidelines promulgated pursuant to <br />28.2 -1301 of the Code of Virginia. <br />Mw <br />• .. <br />.. <br />
