necessary to ensure that such projects result in the successful re- establishment of <br />wetlands protected by Code of Virginia, § 28.2 -1300 et seq. and may require that <br />a prepaid contract acceptable to the wetlands board be in effect for the purposes of <br />carrying out the scientific monitoring plan. In addition, the wetlands board may <br />require a reasonable bond or letter of credit in an amount and with surety and <br />conditions satisfactory to it securing to the commonwealth and /or the city <br />compliance with the conditions set forth in the restoration order. The appropriate <br />court, upon petition by the wetlands board, shall have authority to enforce any <br />such restoration order by injunction, mandamus or other appropriate remedy. <br />Failure to complete the required restoration shall constitute a violation of Code of <br />Virginia, § 28.2 -1300 et seq. <br />Sec. 39 -61. Delegation of ohmirmsm's chair's duties. <br />The duties of the wetlands board chair prescribed in this article may be <br />delegated to his designee; however, such designee shall not be any person who is also <br />designated as an enforcement officer. <br />DIVISION 3. PERMIT TO USE OR DEVELOP WETLANDS <br />Sec. 39 -81. Required. <br />No person shall use or develop any wetland within the city, other than for the <br />purpose of conducting the activities specified in section 39 -24, <br />to=& unless they have been issued a permit pursuant to this division. <br />Sec. 39 -82. Filing of application. <br />Any person who desires a permit required by this division shall file an application <br />th@r-@�@r with the wetlands board directly or through the commission. <br />Sec. 39 -83. Contents of application. <br />An application filed pursuant to this division shall include the following: <br />(1) The name and address of the applicant; <br />(2) A detailed description of the proposed activities; <br />Q3 a A map, drawn to an appropriate and uniform scale, showing the area of <br />wetlands directly affected, with the location of the proposed work <br />thereon, indieati*g the area of existing and proposed fill and excavation, <br />the location, width, depth, and length of any proposed channel and <br />t4o disposal area, and the location of all existing and proposed structures; <br />(34) A detailed description of sewage collection and treatment facilities, utility <br />installations, roadways, and other related appurtenances or facilities, including <br />
