(d) Prior to issuance of a Certificate of Occupancy, the existing chain -link <br />fence along Effingham Street must be removed. <br />(e) Prior to initially operating the self - storage facility, and for so long as the <br />facility remains in operation, the owners and /or operators of the facility <br />shall install and maintain digital video equipment with recording <br />capabilities sufficient to indicate the date and time that the recording is <br />made. The recording shall provide surveillance coverage encompassing <br />the front, side, and rear exteriors of the establishment during the operating <br />hours of the establishment and for at least one additional hour after the <br />close of business. Recorded data must be maintained in a condition <br />permitting review of the information for a period of no less than thirty <br />days. <br />(f) All excavation, land disturbance, and construction/development activities <br />on the property shall be in full compliance with Article II of Chapter 11 of <br />the Code of the City of Portsmouth, Virginia (Excavation Requirements <br />for Abex Superfund Site). <br />(g) The development shall be constructed in compliance with all applicable <br />codes, ordinances and regulations of federal, state and local government, <br />and all required licenses and permits shall be obtained prior to <br />construction and remain in effect during the operation of the development. <br />(h) All taxes /fees associated with the property shall be paid when due, as <br />determined by the City Treasurer. <br />7. REVOCATION OF PERMIT: Violation of any of the conditions set <br />forth herein may serve as grounds for revocation of the use permit by City Council. <br />ADOPTED by the Council of the City of Portsmouth, Virginia, at a meeting held <br />on July 11, 2023. <br />Teste: <br />City Clerk <br />
