That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br />(a) The development shall be in substantial compliance with the concept plan <br />entitled Bird Lane — Portsmouth VA (Conceptual Site Plat — June 15, <br />2021) prepared by the Timmons Group and the building elevations entitled <br />Crossereek Apartments, 2519 Bird Lane, Portsmouth, Virginia 23702 <br />(January 21, 202 1) prepared by T3 Architects, PC, except as may be <br />necessary to comply with any modifications required by state and federal <br />laws and regulations, City Ordinances, and the City Code during site plan <br />review and approval. <br />
