2521 Bird Lane (Tax Parcel 0454 -0050) ALL THAT certain lot, piece of parcel of land lying, being and situate in the City of Portsmouth, Virginia containing approximately 1.77 acres and more particularly described as follows: COMMENCING at the southeastern intersection of Deep Creek Boulevard and Bird Lane; thence along the southern line of Bird Lane 320.47', more or less, to a point (the "True Point of Beginning' thence southeasterly along the south line of Bird Lane 182.7', more or less, thence along the arc of a circle following the south line of Bird Lane 33.49', more or less, to the western line of 519 Bird Lane (Tax Parcel 0454 - 0020); thence southwesterly along the western line of 519 Bird Lane 354.02', more or less, to the northern line of 51 13 Deep Creek Boulevard (Tax Parcel 0453- 0050); thence northwesterly along the northern line of 51 I3 Deep Creek Boulevard 224.38', more or less, to the southeastern corner of _5109 Deep Creek Boulevard (Tax Parcel 0453- 0040); thence northeasterly along the eastern lines of 5109 Deep Creek Boulevard, 5105 Deep Creek Boulevard, and 5101 Deep Creek Boulevard 186.28', more or less, to a point where the line of 5101 Deep Creek Boulevard extends to the southeast; thence southeasterly along the southern line of the said southeastern extension of 5101 Deep Creek Boulevard 21.06 feet, more or less; thence northeasterly along the eastern lines of 5101 Deep Creek Boulevard, 5029 Deep Creek Boulevard, and 2523 Bird Lane 161.61', more or less, to the True Point of Beginning. IT BEING a portion of that certain property conveyed by Deed from JHP Associates to Coastal Housing Corporation dated July 12, 1996 and recorded in the Portsmouth Circuit Court Clerk's Office in Deed Book 1176, at Page 686. 6. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The development shall be in substantial compliance with the concept plan entitled Bird Lane — Portsmouth VA (Conceptual Site Plat — June 15, 2021) prepared by the Timmons Group and the building elevations entitled Crossereek Apartments, 2519 Bird Lane, Portsmouth, Virginia 23702 (January 21, 202 1) prepared by T3 Architects, PC, except as may be necessary to comply with any modifications required by state and federal laws and regulations, City Ordinances, and the City Code during site plan review and approval.
