5. That Community Housing Partners Corporation is hereby granted a use <br />permit pursuant to Section 40.2 -533 of the Code of the City of Portsmouth, Virginia to <br />construct a multifamily dwelling development having not to exceed 71 total units and a <br />leasing office at 2519 Bird Lane and 2521 Bird Lane (Tax Parcels 0454 -0020 and 0454- <br />0050), being more particularly described as: <br />UP -21 -11 <br />2519 Bird Lane <br />(Tax Parcel 0454 -0020) <br />ALL THAT certain piece or parcel of land, situate, lying and being in <br />the City of Portsmouth, Virginia, and designated as Parcel B" 5.116 <br />Acres on a survey of property for Sutton - Portsmouth Associates, <br />Portsmouth, Virginia, dated April 17, 1968, made by Frank D. Tarrall, <br />Jr. and Associates, which plat was intended to be recorded with deed <br />from H and C Development Corporation to Sutton- Portsmouth <br />Associates, dated May 29, 1968, or recorded thereafter, for descriptive <br />purposes only and said parcel of land is more particularly described as <br />follows: <br />BEGINNING at a point in the Southwestern corner of property now or <br />formerly Norport Homes Apartments (Map Book 27, Page 74, <br />Chesapeake, Virginia), which point is in the line dividing this property <br />being conveyed from property now or formerly Norport Homes <br />Apartments, which point is marked by an old pin in concrete and from <br />said point of beginning thus established running thence South <br />71 '4'47" East along said dividing line a distance of 441.98 feet to a <br />point marked by an old pipe; thence turning and running along the line <br />dividing this property from property now or formerly M.E.J. Marshall <br />(Map Book 21, Page 96, Chesapeake, Virginia), South 31'2859 <br />West along the approximate center line of a ditch a distance of 474.55 <br />feet to a point in the Northern line of the property of Norfolk and <br />Western Railway Co. and thence along said Northern line South <br />84'25'59" West a distance of 49.44 feet to a point; thence North <br />70'42'5" West a distance of 57.72 feet to a point; thence North <br />70'42'5" West 328.52 feet to a point; thence South 18'48'01" West a <br />distance of 354.02 feet to a point; thence along the arc of a circle a <br />distance of 170.11 feet, whose radius is 126.66 feet in an Easterly <br />direction and curving to the North to the point of beginning. <br />IT BEING all of that certain property conveyed by Deed of Gift from <br />JHP Associates to VMH, Inc. dated December 20, 1996 and recorded <br />in the Portsmouth Circuit Court Clerk's Office in Deed Book 1189, <br />Page 523. The name of VMH, Inc. was subsequently changed to <br />Community Housing Partners Corporation. <br />
