EXHIBIT A <br />COST SHARING AGREEMENT BETWEEN <br />THE CITY OF NORFOLK AND THE CITY OF PORTSMOUTH <br />FOR WATERLINE RELOCATION <br />THIS AGREEMENT, ( "Agreement') entered into this day of <br />2020, by and between the CITY OF NORFOLK ( "Norfolk "), a municipal corporation of the <br />Commonwealth of Virginia, and the CITY OF PORTSMOUTH ( "Portsmouth "), a municipal <br />corporation of the Commonwealth of Virginia. <br />WITNESSETH: <br />WHEREAS, Norfolk owns a forty -eight (48) inch raw water main located in the railroad <br />right -of -way belonging to the Commonwealth Railway, successor in interest to the Atlantic and <br />Danville Company, located in the City of Suffolk between Nansemond Parkway and Sportsman <br />Boulevard, as shown on Exhibit A attached hereto; and <br />WHEREAS, Portsmouth owns a thirty (30) inch finished water main located in the right- <br />of -way belonging to the Commonwealth Railway, successor in interest to the Atlantic and <br />Danville Railway Company located in the City of Suffolk between Nansemond Parkway and <br />Sportsman Boulevard, as shown on Exhibit A attached hereto, and <br />WHEREAS, Norfolk and Portsmouth desire to relocate their respective water mains by <br />terminating the use of the waterlines currently located in the railroad right -of -way and by <br />establishing new replacement waterlines outside the railroad right -of -way; and <br />WHEREAS, Norfolk and Portsmouth agree that it is in the best interests of both parties <br />to enter into a cooperative agreement whereby Norfolk will (1) procure the services of a <br />qualified engineer to design a new forty -eight (48) inch raw water main ( "NRWM ") and a new <br />thirty (30) inch finished water main ( "NFWM "); (2) undertake the responsibility of acquiring <br />9 <br />
