5. That Appendix A to the Code of the City of Portsmouth, Virginia (2006) is amended as shown on Exhibit A for the purpose of establishing the fee for temporary street or lane closures necessitated by work in the right -of -way authorized by Section 4 above. 6. That Section 9.1 -11 of Chapter 9.1 of the Code of the City of Portsmouth, Virginia (2006) is amended as shown below for the purpose of establishing a fee for reviewing plans of development for compliance with the requirements of the Chesapeake Bay Preservation Overlay District. Except as shown below, Section 9.1 -11 is not amended. Sec. 9.1 -11. - Plan of development process. Any land disturbance, development or redevelopment exceeding 2,500 square feet of land disturbance shall be accomplished through a plan of development process prior to any clearing or grading of the site or the issuance of any building permit, to assure compliance with all applicable requirements of this chapter. The fee for review of plans of development for compliance with this chanter (exclusive of any other applicable fees for review of the plan of development) shall he as set forth in appendix A to this Code 7. That Appendix A to the Code of the City of Portsmouth, Virginia (2006) is amended as shown on Exhibit A for the purpose of establishing the fee for reviewing plans of development for compliance with the Chesapeake Bay Preservation Overlay District authorized by Section 6 above. 8. That Appendix A to the Code of the City of Portsmouth, Virginia (2006) is amended as shown on Exhibit A for the purpose of increasing the fees for review of site plans pursuant to Section 40.1- 2.2(c) of the Code. 9. That Article I of Chapter 11 of the Code of the City of Portsmouth, Virginia (2006) is amended by incorporating subsection 11 -5(e) in the form set forth below into the Code and deleting subsection 11 -6(d) for the purpose of confirming the categories of fees applicable to land disturbance permits. Except as shown below, Sections 11 -5 and I1 -6 are not otherwise amended. NOTE: This amendment was originally made by City Council Ordinance 2013 -49 (adopted on September 24, 2013) but was erroneously not incorporated into the published version of the City Code. The amendment is re- included in this ordinance for the purpose of correcting the published version of the City Code. Sec. 11 -5. - Permits; fees; security for performance.
