} i �jl� 2�1�6�34 AN ORDINANCE TO AMEND AND REORDAIN SECTIONS 32-60,32-61,9.1-11, 11 -5, 11 -6, 38 -56, 38 -40, 38 -42, AND APPENDIX A, AND TO ESTABLISH NEW SECTIONS 25 -91.3 AND 38 -9 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (2006) FOR THE PURPOSE OF INCREASING OR ESTABLISHING RATES AND FEES FOR RIGHT -OF -WAY DISTURBANCE, CHESAPEAKE BAY PRESERVATION REVIEW, TEMPORARY STREET CLOSURES, SITE PLAN REVIEW, LAND DISTURBANCE PERMITS, BOAT RAMP PARKING, WATER METERS AND RELATED WATER AND SEWER SERVICES, BOATING PERMITS, AND METERED PARKING. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Article II of Chapter 32 of the Code of the City of Portsmouth, Virginia (2006) is amended by adding a new subsection (d) as shown below, for the purpose of establishing a fee for performing land disturbance work in the right -of -way without a valid permit. Except as shown below, Section 32 -60 is not amended. Sec. 32 -60. - Issuance of permit; revocation. d) Any person performing or directing the performance of land disturbance work in the right -of -wav without a valid ri ht -of -wav permit shall pay the fee set forth in appendix A to this Code in addition to all fees necessary to obtain a valid ermit_ 2. That Appendix A to the Code of the City of Portsmouth, Virginia (2006) is amended as shown on Exhibit A for the purpose of establishing the fee for performing land disturbance work in the right -of -way without a valid permit authorized by Section I of this ordinance. 3. That Appendix A to the Code of the City of Portsmouth, Virginia (2006) is amended as shown on Exhibit A for the purpose of increasing certain fees for land disturbance work in the right -of -way. 4. That Article II of Chapter 32 of the Code of the City of Portsmouth, Virginia (2006) is amended as shown below by adding a new subsection (f) to Section 32 -61 for the purpose of establishing fees for temporary street or lane closures required by right -of -way work. Except as shown below, Section 32 -61 is not amended. Sec. 32 -61. - Schedule of fees and charges. __ _Fees or street or lane closures. A fee as set forth in a endix A to this Code shall be charged for temporary _street or lane clogires_ necessitated by work in the-right--of-way.
