If an application submitted <br />under this <br />Division 5 is denied <br />in whole or in <br />part, the city <br />engineer shall provide the applicant <br />with a <br />written statement <br />of the reasons for <br />the disapproval <br />and. if the city engineer is aware <br />of modifications <br />to the proposed <br />wireless support <br />structure or <br />wireless facilities that. if made. <br />would result <br />in approval, the <br />city engineer shall <br />identify the <br />modifications in the written statement. <br />Sec. 32 -368. - Permit conditions. <br />Any permit granted under this section shall be subject to the following conditions: <br />(a) The permittee and the wireless support structure shall comply with all requirements <br />applicable to street poles under article IV of chapter 32; and <br />(b) Such other conditions as the city may reasonably require, <br />Sec. 32 -369. - Use by city. <br />To the extent permitted by law, the city reserves the right to request the placement of city - <br />owned communication and signal wires and other related equipment and facilities on all wireless <br />support structures erected in its public ways, free of cost or expense to the city, provided that the <br />city equipment and facilities do not interfere with the structural integrity of the wireless support <br />structure and do not interfere with the use of the wireless support structure by the owner and <br />other existing users. An applicant's refusal of a request shall not be considered as a factor in the <br />review and approval or denial of a permit application. <br />
