(8) Such additional materials as are listed on the application form established by the city <br />engineer and are reasonably required by the city engineer to the extent permitted by <br />law to determine the approvability of a permit in accordance with section 32 -365. <br />(c) Any application not including all of the information listed in this section may be deemed <br />incomplete by the city engineer. <br />Sec. 32- 365. —Application review process -•• <br />Provided applicant has provided a contact email address and paid the appropriate <br />application fee, the city engineer or designee shall notify the applicant by email within ten <br />days of application submittal if the application is incomplete. The notice shall specify why <br />he application is considered incomplete. If the city engineer or designee does not so notify <br />applicant. the application shall be deemed complete. <br />b) During review of a complete application, the city engineer or designee may reques <br />applicant to provide additional information which is reasonably required to the extent <br />permitted by law to determine the approvability of a permit in accordance with section 32- <br />1001:1:1 <br />c) Within 90 days of submittal of a complete application the city engineer or designee shall. for <br />each individual permit request included in an application: (i) approve the individual permi <br />r (ii) deny the individual permit request in writing. including a written explanation of <br />the reason[s] for denial. Except where the city and applicant have agreed upon an extension. <br />any individual permit request not acted on within 90 days or such other period reauired by <br />federal law shall be deemed ap rop ved. <br />Sec. 32 -366. — Basis for denial. <br />=kb�The city engineer shall deny a permit if: <br />(4=a) The proposed wireless support structure or wireless facilities do not comply with applicable <br />law and the terms of the wireless facilities franchise agreement; <br />(2b) The proposed wireless support structure or wireless facilities have a negative aesthetic <br />impact on the surrounding area, considering the size and design of the structure or facilities <br />and the historic, residential, or commercial character of the surrounding area; <br />(3c) The proposed wireless support structure or wireless facilities pose a risk to the public safety, <br />including but not limited to public travel within the public way; <br />(4d) The proposed wireless support structure or wireless facilities are inconsistent with the city's <br />existing or planned public safety communications system; <br />(6e) The proposed wireless support structure does not comply with the requirements of article IV <br />of chapter 32; or <br />(6f) Alternative, less impactful locations which reasonably meet the needs of the applicant are <br />available for placement of the wireless facilities intended to be housed by the wireless <br />support structure. <br />Sec. 32 -367. — Notification of denial. <br />
