EXHIBIT A <br />INTERPRETATION. - Deletions are shown by Miefow 4 . <br />Additions are shown by red font double underlines Portions of Chapter 23 not <br />expressly shown hereon as amended are not amended by this ordinance. <br />CHAPTER 23 - NUISANCES <br />ARTICLE I. — IN GENERAL <br />Sec. 23 -1. — Definitions. <br />The following words, terms and phrases, when used in this chapter, shall, have the <br />meanings ascribed to them in this section, except where the context clearly indicates a <br />different meaning: <br />Affidavit means the affidavit sworn to under oath prepared by LhqjZity#=1ooa14y in <br />accordance with section 23 -91 of this chapter. <br />Alley means a public way, other than a street, designed for vehicular or pedestrian <br />travel to provide access to or from the rear or side of the property. <br />Commercial sex acts means any specific activities that would constitute a criminal <br />act under Article 3 (S 18.2-344 et sea ) of Chapter 8 of Title 18.2 of the Code of Virginia <br />or a substantially similar local ordinance if a criminal charge were to be filed against the <br />individual perpetrator of such criminal activity. <br />Controlled substance means the same as that term is defined in Code of Virginia, <br />54.1 -3401. <br />Corrective action means (i) taking specific actions_with respect to the buildings or <br />structures on property that are reasonably expected to abate criminal blight on such real <br />rop nertv.,including the_ removal repair, or securing of any building wall or other <br />structure, or (ii) changing specific policies practices, and procedures of the real property <br />owner that are reasonably expected to abate criminal blight on real property. A local law- <br />enforcement official shall prepare_ an affidavit on behalf of the city that states specific <br />actions to be taken on the part of the property owner that the city determines are <br />necessary to abate the identified cri minal blight on such real propert y and that do not <br />impose an undue financial burden on the owner. <br />of hi-ild, <br />b b <br />tTF <br />Criminal blight means a condition existing on real nronert v that endangers the public <br />health or safety of residents of the city and is caused by (i) the regular presence on the <br />property of persons under the influence of controlled substances; (ii) the regular use of <br />the property for the purpose of illegally possessing manufacturing or distributing <br />controlled substances: (iii) the regular use of the property for the purpose of engaging in <br />in commercial sex acts; or iv re eated acts of the malicious dischar e of a firearm <br />within any building or dwelling that would constitute a criminal act under Virginia Code <br />
