section, the term "reverse auctioning" means a procurement method wherein bidders <br />are invited to bid on specified goods or nonprofessional services through real-time <br />electronic bidding, with the award being made to the lowest responsive and <br />responsible bidder. During the bidding process, bidders' prices are revealed and <br />bidders shall have the opportunity to modify their bid prices for the duration of the <br />time period established for bid opening. However bulk purchases of commodities <br />used in road and hi~hwav construction and maintenance and a~~re~ates shall not be <br />made by reverse auctionin~.T'-~ -- ~ Af+~~a a, u ~' t » T,.,_, <br />r~' , <br />14. Section 12-220 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />as follows: <br />Sec. 12-220. -Same-Small purchases. <br />(a) A contract <br />,may be made in accordance with small <br />purchase procedures developed by the purchasing administrator. if the a~~re~ate or <br />sum of all phases or terms is not expected to exceed 100 000 in the case of goods <br />and services (other than professional serviced or non-transportation construction• <br />25.000 in the case oftransportation-related construction• or 60 000 in the case of a <br />single or term contract for professional services; provided, however, that contract <br />requirements shall not be artificially divided so as to constitute a small purchase <br />under this section. Purchases under this section that are expected to exceed <br />$30,000.00 shall require the written informal solicitation of a minimum of four <br />bidders or offerors. Awards shall be made to the business offering the lowest <br />acceptable quotation. The name of the business submitting the quotation and the date <br />and the amount of such quotation shall be recorded and maintained as a part of the <br />contract file. <br />(b) A single quotation or term contract may be accepted from any one source in <br />contracts which do not exceed $5,000.00. <br />15. Anew section, designated Section 12-221, is added to the Code of the City of <br />Portsmouth, Virginia (2006) as follows: <br />Sec 12-221 -Same-Con truction <br />Construction may be procured only by competitive sealed bidding except that <br />competitive negotiation may be used in the following instances upon a determination <br />made in advance by city council and set forth in writing that competitive sealed bidding <br />is either not practicable or not fiscally advantageous to the public which writing shall <br />document the basis for this determination• <br />12 <br />
