11. Section 12-214 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />as follows: <br />Sec. 12-214. -Cancellation or rejection of invitations and other solicitations and bids <br />and proposals. <br />An invitation to bid, a request for proposals or other solicitation provided for in this <br />article may be cancelled, or all bids or proposals may be rejected, in whole or in part, <br />when the purchasing administrator, with the approval of the chief financial officer <br />determines that it is in the best interest of the city <br />to do so. The reasons therefor shall be made a part of the solicitation fil~°,...,...a =~ ~'-~ <br />~. <br />12. Section 12-215 of the Code of the City of Portsmouth, Virginia (2006) is amended <br />as follows: <br />Sec. 12-215. -Exemptions from requirements of competitive bidding or competitive <br />negotiation-Generally. <br />(a) The requirements of this article for competitive bidding or competitive negotiation <br />shall not apply to the following: <br />(1) Purchases procured under the supervision of the Virginias Ddepartment for <br />the Blind and Vision Impaired ' or from emnlovment <br />services organizations that offer transitional or sunaortive emnlovment services <br />serving individuals with disabilities <br />,~~~rn~~~t ~iranni ~~@~h-~~~€~t~s~~~l€~ ,...~,.a i -- --- <br />(2) The acquisition of facilities by an industrial development authority under the <br />Industrial Development and Revenue Bond Act (Code of Virginia, § 15.2-4900 <br />et seq., as amended. restated or moved from time to time), and facilities for use <br />by the city, the Commonwealth and its agencies, or other governmental <br />organizations; provided, that any such facilities owned by the city, the <br />Commonwealth or its agencies or other public bodies subject to the Virginia <br />Public Procurement Act shall not be exempt from competitive procurement <br />requirements. <br />(3) The procurement of legal services or the procurement of expert witnesses and <br />other services associated with litigation or regulatory proceedings. <br />(4} Extending the term of an existing contract or services to allow completion of <br />any work undertaken or not completed during the original term of the contract. <br />10 <br />
